EXHIBIT D <br /> M. All mining activities in the area is planned to minimize disturbance to <br /> the hydrologic balance as follows: <br /> (a) The operator agrees to comply with all applicable Colorado <br /> Water law and regulations governing injury to existing water rights. <br /> (b) The Operator agrees to comply with all applicable Federal and <br /> State water quality laws and regulations. <br /> (c) The Operator agrees to comply with all applicable Federal and <br /> State laws with regard to dredge and fill requirements. <br /> The proposed amended area to be mined has no plans of any dredge and fill <br /> activities that will effect waters of the United States. There is a small area <br /> on the west side in Phase VI that may have some wetlands but a setback of <br /> 100' has been planned to avoid any disturbance in that area. <br /> (d) The Operator agrees to remove any erosion or sedimentation <br /> structures that are temporary in nature and not a part of the reclamation plan. <br /> n. Should any human remains or cultural resources be discovered during <br /> mining the operator agrees to comply with CRS 24-80 part Band contact <br /> History Colorado. <br />
