Compliance With Mine Plan NA - Support Facilities Not On-site <br /> N - Other NA - Special Categories Of Mining <br /> NA -Processing Waste R -Topsoil <br /> COMMENTS <br /> This was a partial inspection conducted by Janet Binns of Colorado Divisoin of Reclamation,Mining and Safety. <br /> Mr. Tony Tennyson of Tri-State Generation Compamny represented the operator;Elk Ridge Mining and <br /> Reclamation. The focus of this inspection was to evaluate the areas and reclamation accomplished applied for <br /> bond release in SL25. Two land owners or their representatives met the inspection to voice their conerns <br /> regarding reclamation on their respective properties.. <br /> The inspection was scheduled to begin at 9:00 am at the New Horizon Mine office. When the landowners did not <br /> arrive at the mine office,we were notified that Mr. Dirk Robert's representative,Ms.Kim Schweikhardt,was <br /> waiting at Mr. Richards' property. She met us at the mine office after some phone calls,and then the inspections <br /> progressed to Mr. Dirk Richards' property. <br /> Upon arrival at Mr. Richards access to his property,we observed the second landowner,Mr.Jim Guire,along with <br /> his mother Roseanne,waiting for us on the west end of the GW46 property. We greeted the Guires and let them <br /> know we would meet up with them once we had inspected Mr. Richards' property. They were agreeable with this. <br /> BACKFILL and GRADING—Rule 4.14 <br /> Contemporaneous Reclamation 4.14.1;Approximate Original Contour 4.14.2;Highwall Elimination 4.14.1(2)(f); <br /> Steep Slopes 4.14.2,4.27;Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br /> The landowner,Jim Guire,of GW46,had concerns about differential settling of his property in Section 6. <br /> ERMR has requested this parcel be considered for Phase II bond release. Both Mr. Guire and Mr.Tennyson <br /> concurred that they had been in communication regarding the settling concerns in this area. This parcel was <br /> previously a haul road. Adjacent areas have previously been approved for Phase II bond release,and remain <br /> within the permit area. The post-mining land use is irrigated pasture. This portion of the pasture is irrigated by <br /> side roll sprinklers. Mr. Guire reported that during cutting of the hay,his equipment(swather) sustained damage <br /> due to the extent of the ground settling. Farm equipment can generally accommodate gradual changes in ground <br /> elevation but abrupt elevation offset proves troublesome. The settling in this instance appeared to be 3 to 4 feet <br /> over a short distance. The inspector's gps unit was unable to collect elevation data in this area so exact difference <br /> in elevation was not accurately measured,but estimated. <br /> Number of Partial Inspection this Fiscal Year: 2 <br /> Number of Complete Inspections this Fiscal Year: 0 <br /> Page 2 of 8 <br />
