South Hinsdale Response to Objections
12 July 2022
Mr. Dilione had comments regarding wildlife and water quality (including wetlands) in his County
Specific Comments 15),
Response: These objections on drainage are answered above. The comments on wildlife
added to the County comments are stated and responded to in Section 3.42. To briefly
restate, the information in the application was taken from data and maps provided by the
US Fish and Wildlife Service. It was not until follow-up with CPW and their comment letter
(Section 4.2) that CPW explained where their maps were located so that we could see
CPW's delineation of the winter concentration area and nearby migration paths. These
are identified only for elk and not for deer.
County Specific Comment 12): errors in elevation — depth of mining relative to the river
Response We thank Mr. Dilione for finding the error. The correct difference in elevation
(as determined by GPS and Google Earth is actually 25-35 feet and not 50 or 70 feet, as
measured between the river approximately due west of the Kleckner Lane intersection
with FSR-631 and the western permit boundary. The 70 feet was from the northeast corner
of the permit area (highest area close to the river, and the river itself. We do apologize for
this and have corrected it. Piedra Road's elevation is about 7650-7655. There are various
conflicting data about river OHWM and a full FEMA floodplain study has not been found,
and some GPS indicate river level is as low of 7620 at the bridge. The total change in
elevation from the SW edge (along Piedra Road) to the NE corner(near Kleckner Lane)
is approximately 70 feet, while the ridge near the center of the east permit boundary is
approximately 90 feet above the west edge near Piedra Road.
Mr. Dilione did not understand the method of mining and shape of the excavation, although
it was shown on the maps (Exhibit E) as our explanation was unclear.
There will NOT be a "giant hole" excavated down to within 10 feet of the OHWM of the
Piedra River. The deposit of glacial/alluvial bench material being mined does not go that
far down. It is underlain with shale, which is not suitable material for construction material.
Rather than being what most people think of as a traditional 'pit"but more a notch cut into
the end of the ridge.
