The party or owner installing the planting landscaping will be responsible of maintenance <br /> of the landscaping. <br /> Colorado Springs Utilities shall have the option to trim and cut plantings and trees as may <br /> be necessary to maintain safety and operational clearances of its facilities. <br /> Future power line installations may necessitate the relocation of trees, shrubs,and other <br /> landscaping vegetation. The removal or relocation will be at the owner's expense. <br /> g. Street lights and/or signs shall not be more than 12 feet high and should be mounted on <br /> nonmetallic support. <br /> 4. Colorado Springs Utilities shall have access at all times to the rights of way for operation/ <br /> maintenance/construction/inspection of the facilities. <br /> 5. Colorado Springs Utilities will retain the full rights of the entire easement even if use by <br /> other parties is allowed. Improvements by other parties shall not preclude Colorado Springs <br /> Utilities from installing any additional overhead/underground facilities. Any modifications, <br /> changes, etc. to the other parties' facilities necessary to permit Colorado Springs Utilities to <br /> install its additional facilities shall be at the other parties' expense. <br /> 6. Commercial utilization of rights of way earth material shall not be allowed. <br /> 7. For improvements involving roadways and railroads, safe clearance from line structures must <br /> be maintained. These would generally be: <br /> a. For roads with speed limit over 45mph: Not less than 30 feet from any line structure or its <br /> foundation to edge of nearest driving or turn lane. <br /> b. For roads with speed limit of 45mph: Not less than 20 feet from any line structure <br /> or its foundation to edge of nearest driving or turn lane. <br /> c. For railroad:Not less than 16 feet from any line structure or its foundation to nearest rail. <br /> 8. Line structures at closer distance than specified under paragraph 6,above, as well as those <br /> deemed hazardous or in hazard otherwise, shall be protected by traffic safety barriers to be <br /> installed by the roadway/railroad developer. These safety barriers shall be as specified by <br /> Colorado Springs Utilities and/or other regulatory agency/authority. <br /> 9. Other parties making improvements shall be obligated to bear all expenses towards meeting <br /> these criteria. <br /> 10. Other parties making improvements shall indemnify Colorado Springs Utilities against all <br /> damage,harm inconvenience, interference, etc. arising from the operation of the utilities and <br /> system or failure thereof,to all those utilizing these improvements in the rights of way. <br /> Attached below are some examples of what is/is not acceptable with Electric Transmission Right <br /> of Ways and Easements. <br />
