Everist <br /> purchase/sale agreement. [2011-02-09, ARPSA, Para 9 (e), p.26: "Substantial Reclamation" is <br /> defined as completion of all reclamation obligations other than final re-vegetation...] <br /> The DRMS requires evidence that the reclamation of the Vincent West phase areas being <br /> released from the Fort Lupton permit is acceptable to the responsible party who is taking over <br /> after the acreage release, in this case the City of Aurora. As we discussed, representatives <br /> from Aurora Water have inspected the Vincent West phase areas recently and found the <br /> reclamation to be satisfactory, and completed as per the requirements of the agreement <br /> between Aurora and L.G. Everist. <br /> Another request from the DRMS is an assurance that the released acres will be developed or <br /> maintained after release from the DRMS permit. In the acreage release request to the DRMS, <br /> we'll let them know that the Vincent West release area will be included in the regular weed <br /> control and other maintenance work done by a land contractor working for Aurora. <br /> With reclamation complete and site inspection done on the Vincent West phase, L. G. Everist. <br /> Inc. respectfully requests an acknowledgment of acceptance from the City of Aurora to receive <br /> the reclaimed areas as is. Please indicate your acceptance of the reclamation of the Vincent <br /> West phase by signing, notarizing and returning the attached affidavit. <br /> Please note, L.G. Everist must include a copy of this acceptance letter and affidavit to the <br /> DRMS with the acreage release request.
