Everist, Inc.'s Fort Lupton Sand and Gravel, DRMS Permit M-1999-120 <br /> Dear Mr. Vidmar: <br /> Reclamation has been completed on the Vincent West phase of L.G. Everist, Inc.'s Fort Lupton <br /> Sand and Gravel Mine, DRMS Permit M-1999-120. We respectfully request the City of Aurora's <br /> acceptance of the reclamation. The Vincent West phase in the DRMS permit corresponds to <br /> Everist No. 3- D-09, and Everist No. 4 - D-10W, in the Aurora/LGE purchase/sale agreement. <br /> A copy of the current Division of Reclamation Mining and Safety (DRMS) permit map- Map <br /> Exhibit F - Reclamation Plan Map (revised 11-3-2018) is attached for your reference. <br /> We are also including a copy of the Vincent West-Acreage Release Map (2022) that will be <br /> included with our Acreage Release Request to be submitted to the DRMS. This map includes all <br /> of the acres for which we are requesting release, including the entire Vincent West phase and <br /> an undisturbed area (Area B), located at the south-west corner of the Vincent West reservoir. <br /> (Area B is an undisturbed area that is part of Aurora's parcel, D-09.) <br /> The reclamation work included the completion of the following: construction and testing of the <br /> slurry wall liners, backfilling, sloping, grading and initial seeding of the site. The slurry wall liner <br /> of the Vincent West phase passed the leak test required by the Colorado Division of Water <br /> Resources (DWR), Office of the State Engineer(SEO) and has continued to meet the DWR <br /> design standard. A copy of the DWR's liner approval letter(03/06/19) is attached for reference. <br /> The initial seeding was completed around the upper reaches of the reservoirs after the reservoir <br /> sloping was completed. Additional seeding been completed in the past month, and weed <br /> control is implemented on a yearly basis. <br /> As you know, the DRMS usually requires substantial vegetative growth prior to release of permit <br /> acres. However, L.G. Everist modified its Fort Lupton DRMS permit with Technical Revision <br /> TR-04, in 2009. The TR approval stated, "Modify final vegetation standard to allow release prior <br /> to full vegetation establishment, all other reclamation standards remain in effect." When L.G. <br /> Everist amended the Fort Lupton permit in 2012, we proposed continuing this revision in our <br /> Reclamation Plan and the DRMS accepted the revised reclamation standards and specific <br /> permit conditions in the Preliminary Review letter of AM-02 (dated 05/29/12), which was agreed <br /> to by L.G. Everist, Inc., and ultimately approved with the DRMS Amendment Approval (dated <br /> 10/25/12), Revision AM-02, and incorporated into the Fort Lupton Permit M-1999-120.
