On June 7, 2022,the Division approved the request and has updated
the above-mentioned site status to active status per your request. This letter is to notify you that you are
no longer in Temporary Cessation (TC-2) and that Mining Operations should resume.
The Division has updated the reclamation cost estimate for surface reclamation of the Whirlwind Mine
and found the currently held bond amount of$375,078.00 to be sufficient (attached). Safety rehab work
may be conducted in underground workings for the time being. Prior to any additional developments of
mine workings, the underground portion of the reclamation cost estimate specifically, the bulkhead costs,
will need to be re-evaluated. The Operator will need to provide the Division with three bids from
independent contractors for the scope of work outlined under the Division's Memo: Cost Estimate for
Water Impounding Concrete Bulkheads dated Nov. 14, 2007. Any additional financial warranty required
to cover the underground closures will need to be posted prior to work commencing.
If you require additional information, or have questions or concerns, please feel free to contact me.
Sincerely,
A0e
Amy Yeldell
Environmental Protection Specialist
Ec:Travis Marshall, Senior EPS, DRMS
o C0
Physical: 1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106
Mailing: DRMS Room 215, 1001 E 62nd Ave, Denver, CO 80216 https://drms.co[orado.gov
Jared S.
