Compliance with conditions and directives from the Colorado Division of Reclamation, <br /> Mining, Safety and Colorado Department of Public Health and Environment is required. <br /> Failure to comply or violations from Colorado Division of Reclamation, Mining, Safety <br /> and/or Colorado Department of Public Health and Environment may be grounds for a <br /> revocation of this Special Use Permit. <br /> 3. Hours of operation for the property shall be limited to be between 7:00 am and 7:00 pm. <br /> 4. No stockpiling of materials above the height of the berm surrounding the property may <br /> occur on the property after the commencement of Phase 2. <br /> 5. Prior to commencement of the use approved under this Special Use Permit,the minimum <br /> 10 foot tall berms for Phase 1,identified as Parcel A on the phasing plan,shall be installed <br /> as shown in the application materials.The applicant shall be allowed to process the topsoil <br /> for the construction of the berm. Prior to excavation on the middle parcel, identified as <br /> Parcel B on the phasing plan, the minimum 10 foot tall berms for Phase 2 shall be <br /> installed. Prior to any excavation on the southernmost parcel, identified as Parcel II on <br /> the phasing plan,the minimum 10 foot tall berms for Phase 3 shall be installed. <br /> 6. All berms shall be installed as shown in the application materials and shall be seeded as <br /> identified in the reclamation and vegetation plan. Construction of the berms on the <br /> property shall be done to Town Standards and shall not be installed during any time of <br /> high wind activity to create fugitive dust. All berms shall be monitored for compliance <br /> with the revegetation plan. Annual inspections with the Town and the Applicant shall be <br /> conducted until the vegetation has been established to Town Standards. All vegetation <br /> shall be maintained in good condition during the life of the medium or heavy <br /> manufacturing use on the property. <br /> 7. No storage of materials on the property shall be allowed over the height of the berm. <br /> 8. A vehicular gate shall be installed to prevent any unauthorized persons from accessing <br /> the site. The location of the gate shall allow for trucks and equipment accessing the site <br /> to be located outside of the Gregg Drive right-of-way until the gate is opened. <br /> 9. An address clearly identifying the site for emergency responders shall be installed and <br /> maintained in good condition on the property. <br /> 10. Any new fencing installed on the property shall be installed with a fence permit to Town <br /> Standards and maintained in good condition. <br /> 11. The vehicular tracking pad shall be installed prior to commencement of construction of <br /> the berms and the pad shall meet Town of Buena Vista access requirements at the time of <br /> an access permit.The vehicular pad and access shall physically delineate the location of <br /> the trail along the south side of Gregg Drive for pedestrians and bicyclists. <br /> 3 <br />
