diverted at the new point or points of diversion shall be <br /> used only once. <br /> 3. Applicants shall not be entitled to use the <br /> Bessemer Ditch headgate and the Bessemer Ditch for the <br /> delivery of the water which is the subject matter of these <br /> proceedings until they shall have acquired legal right to <br /> use such facilities. <br /> 6. St. Charles !Mesa Water Association shall con- <br /> struct, operate and maintain at all times at the St. Charles <br /> Men proposed pump stations described above, facilities <br /> approved by the Division Engineer sufficient to measure <br /> on a continuous recording basis all withdrawals of water <br /> from the Arkansas River under this decree. All water taken <br /> at these alternate points of diversion shall be measured <br /> through such facilities. All water taken under this <br /> decree through the Bessemer Ditch shall be subject to <br /> measurement by continuous recording devices approved by <br /> the Division Engineer. <br /> 5. Applicant shall install an adequate diversion <br /> measuring and continuous recording device at Applicants' <br /> present headgate and an adequate control and continuous <br /> recording device at a location at or below the lowest <br /> downstream headgate on Cottonwood Creek to assure the proper <br /> measurement of the water whlch'Applicants would have been <br /> entitled to take at the present headgate and to insure the <br /> adequate measurement and delivery to the Arkansas River of <br /> whatever portion of the 3.8 c.f.s. may not be subject to <br /> call. Said devices shall be approved by the Division <br /> Engineer. Approval of the Division Engineer of any such <br /> devices shall not preclude objection thereto by an Objector. <br /> 6. Such diversion measuring and recording devices <br /> shall be capable of diverting, measuring and recording the <br /> diversion of at least 5 c.f.s., or any part thereof, and <br /> shall re-deliver the amount so measured to the stream.
