The water may be taken through the alternate <br /> points of diversion at rates which, when combined, do <br /> not exceed the permitted rate of diversion and in <br /> quantities when combined together do not exceed the <br /> permitted quantities. <br /> D. If the diversion of the Applicants' water <br /> rights at the new point or points of diversion would <br /> result in a call on water rights of the Objectors that <br /> would not have occurred with the diversion at the <br /> present point of diversion, then the diversion at the <br /> new point or points of diversion shall be arranged or <br /> curtailed or otherwise compensated for, as necessary to <br /> preclude such call that would not have otherwise <br /> occurred. At a minimum Applicants shall be entitled to <br /> divert at the new point or points of diversion 40% of <br /> the amount delivered out of Cottonwood Creek to the <br /> Arkansas River, less transportation losses. The <br /> estimated consumptive use from the irrigation of the <br /> land described in paragraph 9 above is 40% of the <br /> irrigation water applied. <br /> 2. After this decree becomes effective Applicants <br /> shall no longer use their decreed rights for the irrigation <br /> of their land or for any purpose other than those herein <br /> authorized at locations permitted in this decree. After <br /> this decree becomes effective Applicants may use their water <br /> rights for all municipal purposes in the service area of St. <br /> Charles Mesa Water Association, as the same may, from time <br /> to time, be constituted. Municipal purposes include domestic, <br /> irrigation, mechanical, fire protection, sanitary, recreation, <br /> manufacturing and each and every other municipal use. Water <br /> -7- <br />
