confluence of Cottonwood creek and the Arkansas River. <br /> Objectors would be injured to whatever extent the 3.8 c.f.s <br /> does not, in fact, reach the Arkansas River. Injury can be <br /> prevented by limiting Applicants' use at their alternate <br /> points of diversion to the amount of water attributable to <br /> Applicants water rights which in fact is delivered to the <br /> Arkansas River. In order to accomplish this objective it <br /> will be necessary to install an adequate diversion measuring <br /> and continuous recording device at Applicants' present head- <br /> gate and an adequate control and continuous recording device <br /> at a location at or below the lowest downstream headgate on <br /> Cottonwood Creek to assure the proper measurement of the <br /> water which Applicants would have been entitled to take at <br /> the present headgate and to insure the adequate measurement <br /> and delivery to the Arkansas River of whatever portion of <br /> the 3.8 c.f.s. may not be subject to call. <br /> 11. The point of diversion decreed in Civil Action No. <br /> 4396 described above has been used since 1954.
