<br /> TO SAND AND GRAVEL MINING LEASE
<br /> DATED January 1, 1996
<br /> BETWEEN SKELTON, INC.AND UNITED COMPANIES OF MESA COUNTY
<br /> This second amendment to Sand and Gravel Mining Lease ("Second Amendment') is dated
<br /> this --. ' day of March, 2022, between Skelton, Inc., a Colorado Corporation ("Lessor"), and
<br /> Oldcastle SW Group, Inc., dba United Companies of Mesa County, a Colorado Corporation
<br /> ("Lessee").
<br /> RECITALS
<br /> A. Lessor and Lessee entered into that certain Sand and Gravel Mining Lease dated January 1,
<br /> 1996, (the"Lease Agreement"), the subject of which is real property and improvements in
<br /> Section 13, Township 45 North, Range 13 West, N.M.P.M., Counties of San Miguel and
<br /> Montrose, Colorado, as more particularly described in the Lease Agreement.
<br /> B. The Lease Agreement was previously amended on or about December 28, 2010, (the"First
<br /> Amendment")and together with the Lease Agreement(the"Lease") is attached hereto as
<br /> Exhibit A.
<br /> C.The Lessor and Lessee desire to again amend the Lease as more fully set forth herein.
<br /> NOW THEREFORE, for good and valuable consideration,the receipt and sufficiency of which is
<br /> hereby acknowledged, the parties agree as follows:
<br /> AGREEMENT
<br /> 1. The "Leased Premises"as defined in Recital A is hereby amended in this Second Amendment to
<br /> EXCLUDE PARCELS:
<br /> Brent and Cimmaron Alexander's property legally described as: TRACT 1, SKELTON LARGE
<br /> TRACT EXEMPTION AMENDED,SECTION 13,TOWNSHIP 45 NORTH, RANGE 13 WEST,
<br /> COUNTY OF MONTROSE, STATE OF COLORADO, also known by Tax ID No. R0020630
<br /> and the Parcel ID No.4295-132-01-001, and whose address is 1564 County Road 44Z N,
<br /> Norwood, Colorado 81423.
<br /> Ruth Skelton's property legally described as: TRACT 2, SKELTON LARGE TRACT
<br /> EXEMPTION AMENDED,SECTION 13,TOWNSHIP 45 NORTH, RANGE 13 WEST,
<br /> COUNTY OF MONTROSE, STATE OF COLORADO, also known by Tax ID No. R0020631
<br /> and the Parcel ID No.4295-132-01-002, and whose address is 1760 County Road 44Z N,
<br /> Norwood, Colorado 81423.
