is to construct a 200 ton per day facility, and eventually several of them in <br /> locations near areas that need waste rock remediation including Gilpin and Clear <br /> Creak Counties. <br /> JACK D TABB, LLC wishes to appeal to the DBMS Office and Board to apply the <br /> provisions set forth in 6.4.21(e) <br /> The Board shall also consider current or pre-existing conditions and the <br /> degree to which the proposed plan would provide for net Improvements <br /> in the protection of human health, property,or the environment. <br /> This project removes nearly all of the waste rock that are the source of acid- <br /> runoff that plague this beautiful historic mining district. If nothing Is done,the <br /> piles of pre-existing waste rock will continue to leach acid and heavy metals for a <br /> very long time, but by implementing carefully engineered and regulated programs <br /> such as ours a solution is achieved, there are not only are the environmental <br /> benefits to this plan, but new employment opportunities and revenue to the local <br /> economy are also part of the benefits. <br /> Gunnell Mine M-20214068—Specific Application <br /> Post-Mining Land Use Summary: <br /> The proposed post-operations land use is to restore the property to forestry, as <br /> defined by the Colorado MLRB Hardrock Rules. Gilpin County already has the <br /> patented mining claim of this property zoned under the designation of"Mining <br /> Claim" Use-Code: 5000, which,According to the County Assessor means it is <br /> zoned for mining. <br /> The area near the Gunnell Mine is relatively isolated mountainous area, with <br /> limited access and the terrain is gradual and partly forested with mostly pine and <br /> aspen species, restoring this property to forestry by removing and processing the <br /> pre-existing abandoned mine waste rock and reclaiming it to support vegetation <br /> will create a better habitat for wildlife. <br /> Page 3 of 7 <br />
