STATE of COLORADO HIGHWAY ACCESS PERMIT <br /> ADDITIONAL TERMS and CONDITIONS <br /> December 17, 2021 PERMIT No. 321125 <br /> Permittee(s): Gary Knippa <br /> Location: Lake County on CO Highway 024A, near Mile Ref. Pt. 178.141 Right <br /> 16. No drainage from this site shall enter onto the State Highway travel lanes. The Permittee is <br /> required to maintain all drainage in excess of historical flows and time of concentration on site. <br /> All existing drainage structures shall be extended, modified or upgraded, as applicable, to <br /> accommodate all new construction and safety standards, in accordance with the CDOT's standard <br /> specifications. <br /> 17. Open cuts, which are at least 4 inches in depth, within 30 feet of the edge of the State Highway <br /> traveled way, will not be left open at night, on weekends, or on holidays, or shall be protected <br /> with a suitable barrier per State and Federal Standards. <br /> 18. Nothing in this permit shall prohibit the Chief Engineer from exercising the right granted in CRS 43- <br /> 3-102 Including but not limited to restricting left hand turns by constn.iction of physical medial <br /> separations. <br /> 19. Under no circumstances shall the construction of a private driveway by a private interest <br /> interfere with the completion of a public highway construction project. <br /> 20. Any current or proposed cattle guard shall be maintained fully within the property boundaries <br /> and all repairs are the sole responsibility of the property owner. <br /> 21. Backing maneuvers within and onto the state highway right-of-way are strictly prohibited. All <br /> vehicles shall enter and exit the highway right-of-way in a forward movement. Backing into the <br /> right-of-way shall be considered a violation of the Terms and Conditions of the Access Permit and <br /> may result in the revocation of the permit by CDOT and/or Issuing Authority. <br /> 22. This access permit is issued for the entire parcel(s). No additional accesses wilt be granted for <br /> these parcels or any future parcels as a result of splitting or dividing land. All accesses to newly <br /> created parcels shall be provided internally from this access. (This is only for FW, EX, R-A and <br /> NR-A). <br /> 23.The Permittee assumes responsibility for any and all easements that are associated with this <br /> access. If an easement is part of this access permit, CDOT shall not be liable for incorrect <br /> information in the easement documentation and it's the permittees responsibility to ensure all <br /> applicable laws and regulations have been followed. <br /> 24.The Permittee is responsible for obtaining any necessary additional Federal, State and/or <br /> City/County permits or clearances required for construction of the access. Approval of this access <br /> permit does not constitute verification of this action by the Permittee. Permittee is also <br /> responsible for obtaining all necessary utility permits in addition to this access permit. <br /> 25.All workers within the State Highway right-of-way shall comply with their employer's safety and <br /> health policies/procedures, and all applicable U.S. Occupational Safety and Health Administration <br /> (OSHA) regulations - including, but not timited to the appticabte sections of 29 CFR Part 1910 - <br /> Occupational Safety and Health Standards and 29 CFR Part 1926 - Safety and Health Regulations <br /> for Construction. Personal protective equipment (e.g. head protection, footwear, high visibitity <br /> apparel, safety glasses, hearing protection, respirators, gloves, etc.) shall be worn as appropriate <br /> for the work being performed, and as specified in regulation. <br /> 26.The Permittee shall provide accessibility features to accommodate all pedestrians including <br /> persons with disabilities for atl pathways during and after construction. <br />
