The application was called complete for review
on August 2,2021. All comment and review periods began on August 2,2 02 1. The decision date for this
application is currently April 30,2022. Please be advised that if you are unable to satisfactorily address all
concerns identified in this review before the decision date, it will be your responsibility to request an
extension of the review period. If there are outstanding issues that have not been adequately addressed
prior to the end of the review period, and no extension has been requested, the Division will deny this
application. In order to allow the Division adequate time to review your responses to any adequacy issues,
please submit your adequacy responses to the Division no later than one week prior to the decision date.
Please note that any changes or additions to the application on file in our office must also be reflected in the
public review copy, which has been placed with the Custer County Clerk and Recorder.
The review consisted of comparing the application content with specific requirements of Rule 6.1,6.2,6.4 and 6.5
of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction of
Construction Materials. DRMS will require the submittal of a complete application package with exhibits
providing all information contained in the initial submittal as modified by all adequacy reponses to-date, for
further review. A complete final permit will also need to be submitted and at the end of the review process.
Please number and date all pages of further submittals to facilitate the review process. Exhibits noted as
"adequate as submitted"in this letter do not require further modification, but should be included in the re-
submittal for completeness.
At this time,in addition to the adequacy issues identified in this letter, there are significant issues with respect to
proposed permit boundary/affected area, and required access that have not been fully resolved. DRMS will
require that all boundary and access issues be fully resolved, and reflected as necessary in the applicable exhibits
prior to submittal of further permit documents for review. Remaining inadequacies and items requiring
clarification are identified under the respective exhibit heading.
Due to the complexities of accurately and concisely depicting property ownership and access in this setting, which
DRMS considers to be critical to the application process, I would like to suggest the following approach: For all
exhibits which require identification of property ownership, please provide and refer to a map which contains an
accurate depiction of the parcels/claims within, and within 200 feet of,the proposed final permit boundary. The
V.coto
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://drms.colorado.Qov
Jared Polis, Governor I Dan Gibbs, Executive Director I Virginia Brannon, Director
s1976
