The recommendations of referral agencies have been considered. <br /> The application responds to the referral comments generated both during the <br /> Sketch Plan and in the first referral comments for this application. The Board has <br /> considered the referral agencies comments and finds them to have been adequately <br /> addressed through applicant's submittals, including its proposed measures to reduce <br /> impacts. <br /> f. The Applicant has demonstrated that this project can meet applicable <br /> additional criteria listed in Section 4.3 Use Descriptions. <br /> This criterion is not applicable. There are no special criteria or standards listed <br /> for mining. <br /> RESOLUTION <br /> WHEREAS, the Board of County Commissioners has made its findings upon the petition <br /> and upon the recommendation of the Larimer County Planning Commission, which findings <br /> precede this resolution,and by reference are incorporated herein and made a part hereof;and <br /> WHEREAS, the Board of County Commissioners has carefully considered the petition, <br /> evidence and testimony presented to it, and has given the same such weight as it in its discretion <br /> deems proper,and is now fully advised in the premises; <br /> NOW, THEREFORE, BE IT RESOLVED that the petition of Loveland Ready-Mix <br /> Concrete, Inc. for approval to allow open mining of sand and gravel, on-site material processing <br /> and a concrete batch plant on 123 acres upon the property described on Exhibit "A" be and the <br /> same hereby is granted upon the following conditions: <br /> 1. This Special Review approval shall automatically expire without a public hearing if <br /> the use is not commenced within three years of the date of approval. <br /> 2. The Site shall be developed consistent with the approved plan and with the <br /> information contained in the Laporte Pit Special Review File#17-ZONE2113 except as modified by <br /> the conditions of approval or agreement of the County and applicant. The applicant shall be subject <br /> to all other verbal or written representations and commitments of record for the La Porte Pit Special <br /> Review. <br /> 3. Failure to comply with any conditions of the Special Review approval may result in <br /> reconsideration of the use and possible revocation of the approval by the Board of County <br /> Commissioners <br />
