PERMIT#:M-1979-089 <br /> INSPECTOR'S INITIALS:ACY <br /> INSPECTION DATE:February 22,2022 <br /> The mine sign was located on the scale house. The current permit boundary post AR-1 is not easily <br /> distinguishable as the commercial areas all blend together, specifically Area 1 to the north which has been <br /> released. This is cited as a problem. Please properly delineate the entire permit boundary and provide the <br /> Division with photo documentation that sufficient markers have been placed by the corrective action date. A <br /> map depicting the permit boundary post AR-2 is attached. <br /> As previously stated nearly the entire site has been affected. The site consists of a series of irregularly shaped <br /> pit/ponds. The pits do have water in the bottom with approximately 10 feet of highwall above the water to level <br /> ground. The northern pit(pond 1) is approximately 14 acres. The slopes are all 1H: 1V to 2H: 1V which will <br /> require further reclamation. A portion of the pit has been backfilled with concrete material. The Division would <br /> like to remind that Operator that all imported concrete material must be capped with a minimum of 3 ft of <br /> overburden. No rebar was observed during the inspection, and no protruding rebar is permitted in backfill <br /> material. <br /> A backfilled pad area is located to the south and east of pond 1 and is estimated to be approximately 15 acres. <br /> Two to three smaller ponds are located further to the south. Once the water level rises the ponds may flood to <br /> form one to two ponds during times of higher groundwater levels. The southwestern pond(pond 2) is what has <br /> been referred to the Pre-1981 pond is 16 acres. Pond 2 is mostly reclaimed and revegeted except for the eastern <br /> portion that adjoins the more recent mining activities. Ponds 3 and 4 have a very irregular shapes with multiple <br /> height slopes that primarily 1H: 1V to 2H: 1V slopes that require additional grading. Ponds 3 and 4 cover an <br /> area of approximately 14 acres. Additionally there are miscellaneous piles of imported backfill material that <br /> will need to be graded. Pond 5 is the area to be backfilled by pre-cast Concrete approved under TR-6 and is <br /> located within the fenced in area. This pond is estimated to be approximately 5 acres based on satellite imagery <br /> but was not inspected due to the fence. The current reclamation plan calls for this pit to be completely <br /> backfilled then used for commercial/industrial use. <br /> Throughout the site there is a fair amount of historical equipment being stored on site. This equipment may <br /> need to be moved/relocated in order to complete final reclamation if an area is not deemed"commercial <br /> industrial" or will inhibit grading. Additionally there are a few commercial buildings and other previously <br /> approved features that are located within the mine site that will remain post reclamation. <br /> Given that the site is nearly mined out the operator should begin final reclamation in areas where mining has <br /> been completed. According to the reclamation plan revised under AM-3 and later clarified under TRs 5-7, the <br /> pit is permitted to have up to 56.3 acres of pond(s). Currently 4-5 ponds are located on site covering an area of <br /> approximately 45 acres. Most recent revisions continue to depict one large pond however if several smaller <br /> ponds are to remain, an as-built map can be submitted as a TR to depict the post-mining land configuration <br /> upon completion of mining. Areas surrounding the ponds shall be sloped to a 3H: 1V or less with vegetated <br /> slopes. Select areas shall have 5H: 1V slopes per the request of CPW (AM-3 Adequacy Response). These <br /> revegetated pond areas are to have a post-mining land use of recreation and wildlife habitat.No apparent topsoil <br /> piles were observe during the inspection. Next, areas that have been backfilled are to be stabilized with a post- <br /> mining land use of commercial industrial. If necessary for erosion or dust control, temporary vegetation may be <br /> needed in areas where insufficient gravel remains. AM-3 stated that the maximum disturbance on site was to be <br /> 25 acres. At this time much more land has been affected without completion of final reclamation. <br /> General site conditions do not correlate to the approved permit, this is cited as a problem. Overall the mining <br /> and reclamation plans need to be updated to support the current operation and present a clear picture as to how <br /> final reclamation on site will take place. By the corrective action date please submit a technical revision to <br /> revise the Mining/Reclamation Plans and Maps as needed. During this revision process the Division will update <br /> the financial warranty. The Division currently requires a financial warranty amount of$242,500 for this site. <br /> Page 3 of 8 <br />
