Unless the Option is exercised by Grantee, the Option term <br /> expires ten (10)years from the date of this Grant, unless extended by the terms and <br /> conditions of the Confidential Settlement Agreement; but in no event shall the term <br /> of the unexercised Option extend beyond twenty (20)years from the date hereof. <br /> Upon exercise of the Option by Grantee, and completion of the construction of the <br /> Exclusive Easement that is the subject of this Option, Grantee agrees to convey the <br /> Nonexclusive Easement back to Grantor, or its personal representatives or assigns <br /> by way of quit claim deed. <br /> Upon execution of this Grant of Nonexclusive Easement With Option Agreement <br /> to Purchase Exclusive Easement by Grantor, and approval of same as evidenced by <br /> Grantee's signature hereupon, Grantee agrees to withdraw its application for access <br /> to Fremont Placer through land owned by the Bureau of Land Management <br /> pursuant to Grantee's Plan of Operations.
