The primary and emergency spillways were clear and <br /> functional.The embankment was stable and vegetated. <br /> The sumps around culverts C3 and C4,have been excavated and cleaned out. <br /> Above culvert C4,NECC as cleaned sediment out of Ditch D5,NECC should review the design for this ditch and <br /> reseed or otherwise armor the ditch as necessary for long term stabilization. <br /> Ditch D71 has been cleaned out and maintained above the Fill 7 area. <br /> NECC conducted maintenance activities on Ditch D15 by resetting rock in the ditch in areas where side cutting <br /> was occurring. <br /> Pond 008 was holding water but was not discharging. The embankment was stable, and the primary and <br /> emergency spillways were clear and functional. <br /> NECC has placed the sediment they have cleaned from the various sumps and ditches in an area northwest of the <br /> "Knob"in an area previously reported to have be seeded in 2009 based on the 2020 annual reclamation report <br /> map. Mr.Massaroth indicated NECC will cause the recently placed sediment to be spread out and leveled to <br /> blend in with the surrounding topography. Page 2.05-30a of the Permit Application Package (PAP)provides a <br /> plan for the handling of sediment cleaned from Pond 009 to be placed in a"drying area"and then used for mine <br /> reclamation as determined by a soils analysis. PAP page 2.05-33 provides a general plan for handling sediment <br /> cleaning from ponds. NECC should submit a Minor Revision to the permit that clarifies the plan for <br /> handling all material/sediment cleaned from all the sediment control structures as this is not clearly <br /> discussed in the PAP. In addition,the stockpile area used for sediment drying has been re-affected by the <br /> stockpile activity and therefore cannot be considered to have been reclaimed in 2009 as portrayed in the <br /> annual report maps. <br /> NECC has cleaned out the sumps above the checkdams placed in ditch D9. <br /> Pond 006a was holding water but not discharging. The embankment was stable, and the primary and emergency <br /> spillway was clear and functional. <br /> Pond 007a was dry. The primary and emergency spillway was clear and functional. A small rill was observed <br /> southeast of the outlet of the primary spillway on the pond embankment.
