Compliance With Mine Plan N - Support Facilities Not On-site <br /> N - Other N - Special Categories Of Mining <br /> NA -Processing Waste N -Topsoil <br /> CONVOENTS <br /> This was a partial inspection of the Lorencito Canyon Mine,Division of Reclamation Mining and Safety <br /> (DRMS/Division)permit number C-1996-084,operated by New Elk Coal Company,LLC(NECC). I,Jared Ebert <br /> with DRMS conducted the inspection. Mr. Connor Drinkard with DRMS and Vince Massarotti with NECC <br /> accompanied me during the inspection. <br /> BACKFILL and GRADING—Rule 4.14 <br /> Contemporaneous Reclamation 4.14.1;Approximate Original Contour 4.14.2;Highwall Elimination 4.14.1(2)(f); <br /> Steep Slopes 4.14.2,4.27;Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br /> The affected land above Pond 006a was observed. The slopes reported to have been seeded in 2007 and 2009 are <br /> steep and the rills were very visible. NECC,has taken previously action such as placing straw waddles on this <br /> slope,but the rills were quite visible during this inspection. NECC should consider various options to stabilize <br /> this area and conduct repairs during the next construction season. In accordance with Rule 4.14.16,rills and <br /> gullies,which form in areas that have been regraded and topsoiled shall be filled,regraded,or otherwise stabilized <br /> when such rills and gullies disrupt the approved post mine land use,prohibit successful revegetation,or cause or <br /> contribute to a violation of water quality standards for receiving streams. <br /> EXCESS SPOIL and DEVELOPMENT WASTE—Rule 4.09 <br /> Placement; Drainage Control; Surface Stabilization: <br /> Fill 9 was observed. Mr.Massarotti completed several repairs to ditch D92,by resetting rock in various places to <br /> armor areas prone to side cutting. Mr.Massarotti indicated he will interseed these small areas along the ditch were <br /> repair efforts disturbed the growth medium and current vegetation cover. <br /> Fill and 8 were observed,these areas appeared stable.
