January 24,2022 C-1981-012/New Elk Mine JLE <br /> HYDROLOGIC BALANCE -Rule 4.05 <br /> Drainage Control 4.05.1,4.05.2,4.05.3; Siltation Structures 4.05.5,4.05.6; Discharge Structures 4.05.7,4.05.10; <br /> Diversions 4.05.4;Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br /> Drainage—Acid and Toxic Materials 4.05.8;Impoundments 4.05.6,4.05.9; Stream Buffer Zones 4.05.18: <br /> Ditch D34a along the West Portal road was inspected and found to be in good repair. <br /> Containment Area 91 was snow covered but appeared functional. <br /> Containment Area 92 was dry and the embankment slopes of the area appeared stable. <br /> Pond 001a was holding water but was not discharging. The embankment was stable and vegetated.NECC <br /> completed the installation of a pump on the northeast corner of Pond 001a. The vegetation in this area was <br /> disturbed. Mr.Massaroth indicated NECC would seed this area to facilitate the revegetation of the disturbance. <br /> Culvert C8 and C19 were clear and functional. <br /> We walked from culvert C8 east along ditch D15 to ditch D32,no problems were noted. <br /> Culverts C64 and C65 were clear and functional. <br /> Pond 006 and 007 were holding water but were not discharging. The embankments were stable and vegetated. <br /> The Small Area Exemption(SAE) south of Pond 007 was observed. Equipment is being stored in this area. The <br /> stormwater controls installed around this area were in good repair and appeared functional. <br /> NPDES outfall 010 was observed. There was not discharge from this outfall. <br /> Pond 008 was holding water but did not appear to be discharging. The pond embankment was stable and the <br /> primary and emergency spillways were clear and functional. <br /> PROCESSING WASTE/COAL MINE WASTE PILES—Rule 4.10 and 4.11 <br /> Drainage Control; Surface Stabilization; Placement: <br /> A metal pipe was observed north of the wash plant laying on the embankment above the river. NECC <br /> should move or otherwise dispose of this pipe in accordance with Rule 4.11.4(1). <br /> The Refuse Disposal Area was observed. The pile appeared active prior to when the area was inspected,but was <br /> not in operation at the time the RDA was observed. Two haul trucks,a dozer,and compactor are staged on the top <br /> of the RDA. It appears recently placed coal waste was graded and compacted. The reclaimed face of the RDA <br /> was stable and vegetated.
