EXHIBIT M OTHER PERMIT AND LICENSES <br /> No Change <br /> 1 . An Air Pollution permit is not needed for this pit since less <br /> than 70, 000 tons of material is mined each year. <br /> 2 . McAtee Construction Company has the necessary use permit and <br /> zoning for the permit area with :he City of Sterling. Prop- <br /> erty is zoned Heavy Industrial. <br /> 3 . This is an open pit operation and ground water will be ex- <br /> posed. The exposed water at the mine is covered well permit <br /> # 66811F and operated under the Logan Water Users Association <br /> augmentation plan (cases #2007CW0300 & 17CW3262) and is <br /> updated as needed when new lake area is created. <br /> 4 . A dredge fill permit (404) is not required because there will <br /> be no backfilling into waters of the U. S . on this site. <br /> 5. A Storm Water Management Plan (SWMP) has been prepared for <br /> this pit . A discharge permit has been issued for the mine <br /> permit #COG501554 .
