The land where the East Yard Refuse Pile site is located was disturbed pre-law and has been <br /> approved for a post-mining land use of"Undeveloped Land". As such,topsoil was not salvaged <br /> prior to disturbance. Specific details of the reclamation plan for the refuse pile are given on page <br /> 2.05-65a of the PAP,which states that: <br /> The three coal refuse disposal facilities; the East Yard Refuse Facility, located near the <br /> backfilled Somerset Mine C-Seam portal; the West Valley Coal Refuse Facility, located <br /> in the first drainage west of Elk Creek; and the II West Coal Refuse Facility, located in <br /> the second significant ephemeral drainage west ofElk Creek; have been designed and <br /> constructed as permanent structures.As an integral part ofpile construction, completed <br /> pile areas are continuously or periodically reclaimed. Reclamation involves grading <br /> bench outslopes to the design configuration 2H.•I V), grading bench surfaces to promote <br /> effective drainage,placing a minimum of4 feet of suitable cover material, and seeding <br /> and mulching the reclaimed benches and outslopes to protect and stabilize the cover <br /> material. Because the refuse piles are designed as permanent structures, all associated <br /> drainage and sediment control structures (except the sedimentation ponds associated <br /> with the West Valley and II West Coal Refuse Facilities), including undisturbed drainage <br /> diversion ditches, disturbed drainage collection ditches, and rock under-drains will be <br /> retained. <br /> The revegetation success requirement is one of minimum ground cover of living plants adequate <br /> to control erosion,derived using the Universal Soil Loss Equation. Vegetation cover of the <br /> reclaimed area will be successful when total live vegetation cover of the reclaimed areas is equal <br /> to or greater than 90 percent of 19.3%,with 90 percent statistical confidence. <br /> Group 2 (Boreholes/Pads/Roads) <br /> These sites were disturbed post-law and have been been approved for a post-mining land use of <br /> "Undeveloped Land". Topsoil was salvaged at the time of disturbance and conserved in <br /> stockpiles and windrowed berms (along roads). The specific reclamation plan for the borehole <br /> pads and roads requires that: <br /> Topsoil and suitable soil material stockpiled and/or windrowed in berms on the <br /> perimeter of the disturbed areas will be redistributed at uniform thickness and reseeded <br /> in accordance with the revegetation plan presented in Exhibit 2.05-E6, Revegetation <br /> Plan. <br /> Vegetation cover of the reclaimed area will be successful when total live vegetation cover of the <br /> reclaimed areas is equal to or greater than 90 percent of the total herbaceous vegetation cover of <br /> the approved extended reference area with 90 percent statistical confidence <br /> PHASE III <br /> Rule 3.03.1(2)(c) states that the final portion of performance bond, "shall be released when the permittee <br /> has successfully completed all surface coal mining reclamation operations in accordance with this <br /> C-1981-022 Page 8 of 16 <br />
