• Regrading of disturbance areas to the approved post-mining configuration, with grading to blend
with surrounding undisturbed and previously reclaimed areas and reestablish effective site
drainage
• Construction of designed post-mining drainage channels
No structures requiring demolition were present within the footprint of the SL-5 parcels.
Details of the TC-1 and TC-2 wells are available in Exhibit 2.04-E3 Tab I, Item 9 of the PAP. The
exhibit shows that in 2007 TC-1 was plugged and abandoned and TC-2 was permitted as a domestic
supply well. No additional disturbed acreage was approved at the time the construction of the wells was
permitted(with Minor Revision No. 38).
The approved post-mining topography of the East Yard area is shown on Map 2.05-M6, Sheet 1 of 7 of
the PAP.
PHASE II
Rule 3.03.1(2)(b) states, "Up to eighty-five percent of the applicable bond amount shall be released upon
the establishment of vegetation which supports the approved postmining land use and which meets the
approved success standard for cover... based on statistically valid data collected during a single year of
the liability period". In regard to Phase II bond release, Rule 3.03.2(3)(b) also states, "No more than
sixty(60)percent of the bond shall be released so long as the lands to which the release would be
applicable are contributing suspended solids to streamflow or runoff outside the permit area in excess of
premising levels as determined by baseline data or in excess of levels determined on adjacent nonmined
areas".
With regard to Phase II bond release, details of the approved reclamation plan are given in Exhibit 2.05-
E6,Revegetation Plan, of the PAP which states that:
As a first step in seedbed preparation, in areas where soil will be replaced, compacted surfaces
will be ripped to a depth of at least 12 inches before applying soil. In areas where soil is not
available for replacement or where surface materials are suitable, areas will not be ripped to a
depth that exposes any undesirable underlying materials. If this depth is less than six inches, then
soil will be added to attain a minimum depth ofsix inches.
The woody stem standard has been waived on all reclaimed areas, at the request of the land
owners/managers. Specific requirements of the plan (including the approved seed mix,the success
criteria and the sampling methodology) depend on the following factors:
• When the disturbance occurred(pre-law or post-law)
• Surface ownership(USFS,BLM, Oxbow or Hotchkiss Ranches)
• Vegetation community(Pinon juniper,Mountain shrub or Aspen/Conifer woodland)
• Post-mining land use (Undeveloped land or Industrial/Commercial)
The parcels included in the SL-5 application can be divided into two groups:
Group 1 (East Yard Refuse Pile)
C-1981-022 Page 7 of 16
