Applicant shall obtain approval of a 112 mining permit from the Colorado Division of <br /> Reclamation, Mining and Safety(DBMS)and comply with the terms and conditions of such <br /> permit throughout its operations, including reclamation requirements. <br /> c. Applicant shall obtain approval of a U.S. Department of Labor,Mine Safety&Health <br /> Administration(MSHA)permit and comply with the terms and conditions of such permit <br /> i <br /> throughout its operations,including reclamation requirements. <br /> d. Applicant shall obtain air quality and water quality and storm water permits from the <br /> Colorado Department of Public Health&Environment(CDPHE)and comply with the terms <br /> and conditions of such permit throughout its operations. <br /> t <br /> e. Applicant shall apply for and obtain a County access permit;access shall comply with <br /> County and MSHA standards. <br /> f. Applicant shall submit evidence that Colorado Parks and Wildlife has no concerns with the <br /> proposed access. <br /> g. Applicant shall obtain consent for any ditches crossed by the proposed access. <br /> h. Crushing shall be limited to Nov 1 through March 31 and crushing limited to a total of eight <br /> weeks during that period. <br /> i. Operations shall only take place during actual daylight and shall in no event take place <br /> outside of 7 am to 6 pm,Monday through Friday. <br /> j. There shall be no incidental use of CR 140 or CR 250 in connection with the operations other <br /> than emergency vehicles. <br /> k. Applicant shall coordinate with the County a location for a topsoil berm to control dust and <br /> noise. <br /> 1. Applicant shall comply with all requirements of the Chaffee County Weed Department <br /> throughout its operations and during reclamation. <br /> 2. Land Use Changq Permit. <br /> a. This Resolution shall constitute the Land Use Change Permit granted in connection with the <br /> Application. <br /> b. This Permit is limited to the operation as described in the permit application,as amended <br /> during the public hearing process orally or in writing. Specifically,there shall be no <br /> expansion of the pit acreage or depth without County approval through a public process. The <br /> Permit conditions shall include all agreements and representations of Applicant made during <br /> the public hearing process. Applicant shall notify the County of any proposed change to the <br /> operations as represented to the County. <br /> c. In addition to the remedies provided by the LUC, if the County determines that any material <br /> representation made by Applicant in the permit application or during the public hearing <br /> process is false or deliberately misleading,the County may pursue an enforcement action for <br /> violation of this Permit. <br /> Page 3 of 4 <br />
