Section 7.2.3.0 of the LUC regarding operational characteristics. <br /> 7. Section 7.2.3.F of the LUC regarding riparian areas with respect to the proposed access and <br /> the North Fork Ditch. <br /> 8. Section 7.2.5 of the LUC regarding reclamation and noxious weed control. <br /> 9. Section 7.2.6 of the LUC regarding storm water run-off. <br /> 10. Section 7.2.7 of the LUC regarding water quality. <br /> 11. Section 7.8.23 of the LUC regarding compliance with state and federal regulations relating to <br /> mining,air quality,water quality and water law,storm water and reclamation. <br /> H. Provided the applicant and the operation comply with certain conditions,the application will meet the <br /> requirements for a Major Impact Review Land Use Change Permit. See Section 1.3.6.3 of the LUC. <br /> L Section 2.2.3.C.allows the County"to restrict operating hours,develop landscaping, increase <br /> setbacks,or similar mitigation in order to minimize potential impacts on nearby residential uses and <br /> to meet the intent and purpose of the Rural zone." <br /> J. On September 5,2017 the Board voted unanimously to approve the application subject to conditions, <br /> and directed the County Attorney to prepare a written resolution outlining the findings and conditions <br /> of the Board for consideration at the September 12,2017 meeting of the Board(such consideration <br /> was continued to the September 20,2017 meeting). <br /> RESOLUTION: <br /> The Board of County Commissioners of Chaffee County resolves as follows: <br /> 1. Approval of Major Impact Review Land Use Change Permit. Based upon the findings set forth <br /> above,the foregoing application is approved for a Major Impact Review Land Use Change Permit <br /> allowing ACA to engage in the proposed surface gravel mining operation, including extraction uses, <br /> on the property,subject to the following conditions. <br /> a. Applicant shall apply for and receive a CDOT access permit to address the impacts to <br /> Colorado State Highway 50 and shall provide opportunity for the County to provide feedback <br /> on the application permit. <br /> Page 2 of 4 <br />
