3 Other Agency Environmental Protection Measures <br /> OSMI has in place other State and Local permits and licenses necessary to perform mining and <br /> related activities. Each of these permits have specific environmental protection measure for their <br /> regulatory jurisdictions. A list of OSMI's other permits and licenses is provided in Exhibit M. <br /> Copies of the permits are available in OSMI's environmental files. <br /> 3.1 Local Agencies <br /> Ouray County is a right to mine county and therefore no county-specific special use permit is <br /> required. However, this does not include the admin building, which requires county building <br /> permits to construct as this is a building that will remain post mining. <br /> OSMI, in collaboration with Ouray County, developed a weed control plan as well as a suitable <br /> the reclamation seed mix for the site. In addition, OSMI also has an agreement in place with <br /> Ouray County to maintain the County Road 361 during the winter operating months. <br /> 3.2 Federal Agencies <br /> - Fringe Lease (USFS): OSMI is currently working with the Forest Service (FS) and <br /> Bureau of Land Management(BLM)to access locatable minerals on FS-owned <br /> claims that adjoin OSMI's patented claims. OSMI has a prospecting permit from the <br /> BLM and is in the process of securing a Fringe Lease from the FS and BLM, which <br /> will allow OSMI to access minerals from underground on adjacent claims owned by <br /> the FS. None of the Fringe Lease claims are expected to include storage of designated <br /> chemicals as the lease prohibits any surface activity and water generated through <br /> mining these claims will drain to the main Revenue tunnel and will be captured and <br /> treated in the five-stage passive mine water treatment system and discharged via the <br /> permitted outfall. <br /> - OSMI has a current Spill Prevention, Control and Countermeasure (SPCC)Plan in <br /> conformance with the U.S. Environmental Protection Agency's (EPA's)regulations <br /> for aboveground storage of more than 1,320 gallons of petroleum products. This plan <br /> provides measures for properly storing and handling petroleum products and <br /> responding to, and reporting, spills. In addition, OSMI a Materials Containment Plan <br /> (MCP), which addresses non-petroleum-based chemical storage and spill prevention. <br /> Copies of the SPCC Plan and MCP may be found in Appendix 1. <br /> - OSMI has an Army Corps of Engineers (ACOE)permit for the Mine Water Pond <br /> (Pond #1). <br /> M-2012-032 <br /> Amendment 02 Exhibit U <br /> December 2021 U-8 <br />
