November 22,2021 C-1981-012/New Elk Mine JLE <br /> GENERAL MINE PLAN COMPLIANCE: <br /> Based on the mine maps located in the main office area,NECC appears to be mining in the 2021 areas of the Blue <br /> Seam as approved on Map 03 of the Permit Application Package (PAP). <br /> DRMS approved a drilling program with TR74. Drill holes/pads NE-04-20,NE-02-20,NE-03-20,NE-09-20,NE- <br /> 12-20,NE-10-20,and NE-07-20 were observed. Drilling and pad construction has not occurred at NE-09-20 and <br /> NE-10-20. Drill holes NE-12-20,NE-07-20,NE-03-20 appear to have been plugged/sealed and the drill pads have <br /> been backfilled and graded to blend into the surrounding topography,topsoiled,and seeded. NECC will need to <br /> mark the location of the sealed drill holes with a 4 foot long by 5/8 inch rebar pin at the top of the plug and <br /> cap the pin with a 1 1/2 inch diameter aluminum cap as approved in the PAP and in accordance with Rule <br /> 4.07.3(2)(b). In addition,for the drill holes that have been permanently sealed,NECC will need to provide <br /> proof of compliance with the plugging and sealing plan by providing a report in accordance with Rule <br /> 4.07.3(2)(c)by January 29,2021. <br /> Dri11 hole NE-04-20 has been drilled and subsequently plugged and sealed. The drill pad for this site has been <br /> constructed but not yet reclaimed. <br /> PROCESSING WASTE/COAL MINE WASTE PILES—Rule 4.10 and 4.11 <br /> Drainage Control; Surface Stabilization; Placement: <br /> The Refuse Disposal Area(RDA)was observed. The wash plant was not operating at the time of the inspection <br /> and waste was not actively being placed on the pile. However,it is clear recent waste material has been stockpiled <br /> in several locations at the top of the RDA. Several truck dump piles were observed at the top of the upper bench <br /> of the RDA. NECC recently acquired a compactor and have begun to compact the newly placed lifts on the RDA <br /> with this equipment. According to Mr.Massarotti,NECC has tested the compaction of the lifts. NECC must <br /> include the results of these tests in the quarterly waste pile inspection reports in accordance with Rule 4.10.2(2)(b). <br /> The face of the reclaimed lower benches of the RDA are stable and vegetated and the side drains appeared stable <br /> and functional. <br /> ROADS—Rule 4.03 <br /> Construction 4.03.1(3)/4.03.2(3),Drainage 4.03.1(4)/4.03.2(4), Surfacing and Maintenance4.03.1(5)and <br /> (6)/4.03.2(5) and(6),Reclamation 4.03.1(7)/4.03.2(7): <br /> The new haul road that was the subject of the violation issued last month(CV2021001)was not being used at the <br /> time of the inspection. <br /> New light use roads as approved with TR74 to the locations of drill holes NE-04-20,NE-07-20 and NE-03-20 <br /> were observed.The roads to NE-7-20 and NE-03-20 have been graded,topsoiled and seeded.The road to NE-04- <br /> Number of Partial Inspection this Fiscal Year: 2 <br /> Number of Complete Inspections this Fiscal Year: 2 <br /> Page 4 of 12 <br />
