M-1 AIR EMISSIONS, CONTROL, MITIGATION, AND PERMITTING <br /> All operations and equipment producing air emissions, including fugitive and point-source dust,combustion <br /> emissions, and vapor emissions,will be permitted by the State of Colorado(CDPHE-APCD)and will operate in <br /> accordance with permit conditions and good engineering and environmental practices for both stationary and mobile <br /> sources. <br /> Processing and Combustion <br /> No processing or combustion equipment will be located permanently at the site.All equipment will be portable, <br /> even if stationary sources, and generally moves from one operation to another, in Colorado and New Mexico. Since <br /> equipment will be usually be replaced, upgraded, or substituted during the life of the operation, it is not possible to <br /> provide APCD permit or registration numbers.However,County agencies will be provided such information(if required) <br /> as part of the submission of relocation notices to APCD before and after equipment is located on the site. <br /> Portable equipment in Colorado is required to file Air Pollution Emission Notices (APENs) every five years <br /> and if greater than State-established thresholds for emissions or equipment size,to obtain and maintain an Emissions <br /> Permit, which establishes minimum conditions (requirements) for operating, typically including limits on fuels, <br /> feedstock, operating hours, rates of operation, and monthly and annual production and emissions limits. <br /> Fugitive Dust <br /> As annual production is expected to exceed the 70,000 ton/year threshold of APCD,the operation will file <br /> APENs every five years,obtain an emissions permit(which includes a APCD-approved fugitive dust control plan), <br /> and comply with the conditions(requirements, including limits and mitigation measures)of the permit,The State <br /> issues and updates a permit for fugitive dust and other air emissions based on the APEN,which establishes source- <br /> specific conditions enforced by APCD, including prevention and control of fugitive dust emissions. <br /> Fugitive dust from conveying material, stockpiles, work areas, and traffic will be mitigated and controlled <br /> through various means, including enclosure, application of dust control agents and water(as needed), speed limits, <br /> siting, and other suitable measures. Dust exceeding an opacity limit of 20%(6-minute average)may not be allowed <br /> to cross parcel boundaries or create any visual hazard on public roads. If necessary,operations will be curtailed <br /> during extreme wind conditions. <br /> Dust Control for Hauling Materials off-site <br /> In addition to dust control practices to be used in the pit,control of dust generated by materials haul on the <br /> access road and from hauled loads will be practiced. On the access road,this will include traffic control(speeds and <br /> intervals),water spraying (see Exhibit G),and use of dust control agents such as magnesium chloride brine <br /> (magwater)or ligneous sulfide, as needed. When hauling material less than t/<-inch, haul trucks will be controlled to <br /> prevent dust,including tarping(chemically or physically)or wetting of material in accordance with state and local <br /> requirements. If necessary, hauling will be curtailed during extreme high wind conditions. <br /> NOTES: <br /> 1. APEN and Air Emissions Permit Application will be submitted to County when approved by CDPHE-APCD <br /> for the pit operations. <br /> 2. APEN and copies of issued permit(s)when issued or when equipment is selected to be moved to this site <br /> will be submitted to the County. <br /> 3. The current fugitive dust control plan is provided as an attachment to this exhibit. It may be revised based <br /> on the APCD permits,when issued. <br /> 4. When fuel-burning stationary equipment(such as gen sets),crushing and screening equipment is relocated <br /> to or from this operation,the operator submits a relocation notice to APCD. Unless otherwise required,this <br /> notice will not be provided to county agencies. <br /> 5.
