Rule 6.4.4 Exhibit D Mining Plan
No changes or updates were needed to the typed mining plan itself regarding the correction of
the 10 acre discrepancy.
Rulc 6.4.5 Exhibit E Reclamation Plan
Please see the attached Reclamation plan that was updated to reflect the accurate pls/acre
listings that were erroneously omitted from the originally submitted Exhibit E.
Rule 6.4.7 Exhibit G Water Information
Please see the enclosed information taken from the Colorado Division of Water Resources
regarding groundwater levels and well information for 3 locations near/around the proposed
permitted area. Information includes a map showing the location of the groundwater
monitoring sites and 3 wells, which include both wells mentioned in Exhibit S. Groundwater at
all locations was greater than 140' from the surface.
Rule 6.4.9 Exhibit I Soils information
Please see enclosed information obtained from the Baca County NRCS office regarding top soil
and general soil information. Specific soil horizon profiles are not available from Baca County
NRCS for this area.
Rule 6.4.12 Exhibit L Reclamation Cost Estimate
No action needed from Operator/Permittee for the preliminary adequacy review regarding this
item. Operator/Permittee will begin the process to obtain a Financial Warranty.
Rule 6.4.19 Exhibit S Permanent Man-Made Structures
Exhibit S has been updated to reflect all man-made structures that are within 200' or less, of
any proposed permitted area boundaries. Please note that with the correction of the 10 acre
discrepancy in the proposed permitted area, the East boundary has been moved further West,
and the hay barn and County Rd 33.3 are now greater than 200' from the eastern boundary, and
the well in the southeast corner of the previously proposed permitted area is no longer inside
the proposed permitted area. Also, there is only a single water line that runs from the well at the
southeast comer north to the well that is located in the irrigated circle, and upon further
discussion with the Landowner, it has been determined that the dormant well in the irrigated
circle was not previously operated using natural gas, it was electric, so there is not a gas line
within 200' of the proposed permitted area.
