Of Reclamation, Mining, and Safety DIVISION OF RFIC LA NIATION
1313 Sherman St Room 215 MINING A:.D•+'AFLTY
Denver, CO 80203
Dear Ms. Reilley,
Please find below our responses to the Preliminary Adequacy Review for Permit
M2021050 dated October 11, 2021.
Rule 1.6.20)(d) and(e) and(g)
Updated notices to the Board of County Commissioners and the Conservation District have
been signed, and were delivered to these entities the day they were signed. The originals are
enclosed with this letter.
Formal affidavit of publication; proof of notice; and documentation showing that all Owners of
Record of surface and mineral rights of the affected land and all Owners of Record within 200'
of the boundary were mailed a copy of the public notice were all uploaded to Laserfiche on
09/28/21 by DRMS staff.
Rule 6.3.3: Exhibit C Mining Plan Maps
All incorrect maps have been updated to correct the 10 acre discrepancy, to the best of the map
software's capabilities. Please note that the MRCS' mapping programs and capabilities have
changed since the maps were done in 2018. The ESD and other soils maps encompass an area
slightly greater than 50 acres due to limitations in the software program's drawing function, but
the maps do give the soils information for the proposed permit area of 50 acres. The Mining
Permit Area map; Mining Phases map; Direction of Mining map; and the Adjoining Surface
Owners of Record within 200' map have all been updated to show the change in the proposed
permitted area boundary. The maps are all enclosed with this letter, as is a map depicting the
location of all man made structures within 200' of the affected area. All man made structures
within 200' are owned by the landowner with the exception of the power line owned by
SECPA. Ownership is noted in the title/description box at the top of the map.
