To: Mr. Peter Hays
Date: October 8, 2021
Page 5
EXHIBIT D - MINING PLAN
Comment 9
On Page 6, Exhibit D, the Applicant states the entire site consists of approximately 114
acres. The Applicant listed the proposed permitted acreage on the application form as 118
acres. Please explain this discrepancy the revise Exhibit D or the application form
accordingly.
Response 9
The initial, internal application was based on preliminary data as reported by the Weld
County Assessor's office (118 acres). The 114.25 acres is based upon an Alta survey
prepared by a licensed professional surveyor. Not changing the 118 acres to 114.25 acres
in the application was an oversight on our part. We have updated the application to reflect
the survey-verified 114.25 acres as reported in Exhibits A and D.
EXHIBIT F - RECLAMATION PLAN MAP
Comment 10
The Applicant submitted Reclamation Plan Maps (Exhibits R-1 through F-3) labeled as
"drafts". The Division does not review draft copies of application exhibits. Please provide
final copies of the Exhibit F maps for Division review.
Response 10
The exhibits no longer include the draft marker.
Comment 11
The Exhibit F maps must be prepared and signed by a registered land surveyor,
professional engineer or other qualified person pursuant to Rule 6.2.1(2)(b). Please
provide signed copies of the Exhibit F maps.
Response 11
We typically stamp engineering drawings after respective agencies review to incorporate
changes into a final form and to certify the changes are accepted by the engineer and
agency. To meet the rule requirement, we have provided professional engineer's seal as
requested on pertinent engineering drawings.
20211006_Response to DRAB(A utoRecovered).docx T E L E S T O
