This agreement was provided in <br /> the original conversion application. <br /> SUBSURFACE (MINERAL)ACCESS: <br /> The subsurface (mineral) owners in the 112c permit area consist of: US Government (managed by BLM); <br /> Bill Tezak; Colorado Quarries Inc; David and Debra Knight Living Trust; and Viscount Mining Corp. <br /> Colorado Quarries' right-of-entry to subsurface (minerals) can be summarized thus: <br /> a. The BLM's Record of Decision approving expansion of the permit area was provided in the <br /> original conversion application. This includes right-of-access to the federal minerals. <br /> b. Bill Tezak has granted right-of-entry to Colorado Quarries to mine and reclaim in the permit area. <br /> c. Colorado Quarries has granted Colorado Quarries right-of-entry to mine and reclaim. <br /> d. Lease Agreement between David and Debra Knight Living Trust and Viscount Mining Corp.,for <br /> (claims) properties identified as: RHC 1-8, RHC 14-16,SCP 19-20,WHC 1-9, and Rosie 1-74. <br /> Approximately 17 of the Rosie claims are located within the 112c area, and appear in the SE <br /> corner of that claim block(see the map in the lease addendum, being page 21 of that lease <br /> document). The BLM also refers to this block of claims as the "Sullivan Lode Claims" as seen on <br /> the new map provided under Exhibit C. The David and Debra Knight Living Trust has granted <br /> right-of-entry to Viscount Mining Corp. This lease document was provided previously in the <br /> conversion application. <br /> e. Bill Tezak entered into a lease with Viscount Mining Corp for these lands, which grants right-of- <br /> entry for mining and reclamation. This lease agreement between William Tezak,Viscount Mining <br /> Corp., and Viscount Colorado Holdings Ltd.,for all the claims identified and described in the <br /> Knight-Viscount lease,ties the Knight-owned properties to William Tezak. The lease agreement <br /> was provided previously in the conversion application materials. <br /> For more information, see the following maps: <br /> Exhibit C "Surface Ownership Map" for identification of owners of individual parcels within the 112c <br /> permitted area and within 200 feet of the boundary. <br /> Exhibit C"Map of Patented and Unpatented Claims, and Mineral Ownership" showing surface lands <br /> included in these leases (appearing as "Sullivan Claims"). <br /> Exhibit C "Map of Surface and Mineral Ownership Classes, Claims and Easements" showing private and <br /> federal surface and subsurface ownership and easements. <br /> We verify that all owners of substance to be mined have been sent a notice regarding this conversion, <br /> and we have legal right-of-entry. <br /> Exhibit O—Owners of Records of Affected Land (Surface Area) and Owners of Substance to be Mined <br /> As requested, updated and corrected maps as well as corresponding owners' lists have been provided, <br /> under Exhibit C and Exhibit N, identifying the owners and specific parcels, lying within the boundaries <br /> and within 200 feet of the boundaries of the proposed 112c permit. <br /> Exhibit S—Significant Manmade Structures <br /> There are two overhead powerlines crossing the proposed permit area, both owned by Sangre de Cristo <br /> Electric. As one of the new Exhibit C maps and Exhibit D Mining Plan both reflect,there will not be any <br /> affected land within 200 feet of those structures. Colorado Quarries will maintain an unaffected 200- <br /> foot setback from the lines and poles. <br />
