<br /> <br /> <br />2. Please submit proof that notice was provided to all Owners of Record: <br />a. of surface and mineral rights <br />b. of land surface within 200 feet of the boundary. These may be return receipts of certified <br />mailing or other method. <br /> <br />Rule 6.4.4 Exhibit D Mining Plan <br />DRMS understands that excavation will be conducted in 5 to 6 foot lifts on a level area for loading trucks <br />as per Exhibit D. Earthmoving is stated as moving from west to east. Material extraction is noted on <br />Exhibit F as beginning on the south end and progressing northward. <br /> <br /> Please clarify the discrepancies in the mining direction and submit associated revised pages or <br />maps. <br /> <br />Affected area requested in Exhibits C, E, F, and L is 110 acres, yet the permit application page, signed on <br />2 August 2021 and part of the incompleteness response calls out the permitted acres as 91.1 acres. There <br />appears to be a disconnect between the various exhibits and the permit application page. Please note, if <br />additional acreage beyond the requested 91.1 acres will be affected, the applicant will need to submit an <br />amendment to the permit application for this additional area. <br /> <br />Exhibit D states the Raindance operation is a 55 acre site. DRMS notes a difference of 55 acres between <br />affected area and the acreage stated for the site. <br /> <br />The reservoir acreage is stated at 44 acres with 11 acres to be revegetated, yet Exhibit L states <br />revegetation of 55 acres. It appears to DRMS that there is an acreage discrepancy in the acres requiring <br />reclamation. DRMS notes the area from the high water line up to the top of the berm at an approximate <br />elevation of 4940 feet is to be seeded and mulched. <br /> <br />3. Please clarify and update affected acreage with appropriate revised pages addressing the entire <br />application. <br />4. Please verify and update acres to be reclaimed and revegetated as there are discrepancies across <br />the permit application and provide revised pages for all sections and exhibits. <br />5. Please explain the acreage discrepancies assuring DRMS of the acreages outside the water <br />surface requiring reclamation; grading topsoiling, seeding and mulching. <br />6. Please show on a map all acres to be topsoiled, seeded and mulched. <br />7. Has the topsoil stockpile location area been included in the acres topsoil and seeded? <br />8. What is the approximate acreage of the topsoil stockpile. <br /> <br />Rule 6.4.5: Exhibit E Reclamation Plan as per Rule 3.1 <br />DRMS notes the acreage discrepancies throughout the application as noted above. DRMS notes that 4 <br />inches of plant growth medium will be applied to reclaimed areas. Please clarify if that is in addition to <br />topsoil or inclusive of topsoil. Evidence of groundwater protection will be submitted to DNR as per a <br />well permit. <br /> <br />9. Please clarify the need for additional topsoil and discuss the importation of topsoil in the <br />Mine Plan. <br /> <br />
