<br /> <br />Mr. Martin Lind <br />VIMA Partners, LLC <br />1625 Pelican Lakes Point, Suite 201 <br />Windsor, CO 80550 <br /> <br />9 September 2021 <br /> <br />Re: Raindance Reservoir Pit M2021049 <br />DRMS Preliminary Adequacy Review of Permit Application for 112 Operation <br /> <br /> <br />Dear Mr. Lind; <br /> <br />The Division has completed its preliminary review of the Raindance Reservoir #2 Pit 112 application. <br />The revision was received by the Division on 19 July 2021. The revision was considered incomplete on <br />30 July 2021. On 9 August 2021 The Division received responses to the incompleteness evaluation and <br />considered the revision filed for review. The Division deemed the permit application complete on 11 <br />August 2021. On 27 August 2021 The Division received a concurrence letter from the Division of Water <br />Resources (DWR), regarding conditions for approval. On 1 September 2021 The Division had a <br />conversation w <br />Patterson informed DRMS that in advance of mining, a well permit would be sought for any possible <br />groundwater exposure. <br /> <br />The Division understands that the future land use will be a Developed Water Resource and that the current <br />land use constitutes general agriculture. <br /> <br />Applicable rules of the Minerals Rules and Regulations of the Mined Land Reclamation Board for <br />the Extraction of Construction Materials (referenced by Rule and number), and Article 32.5 of the <br />Colorado Land Reclamation Act for the Extraction of Construction Materials (referenced by act <br />section), were utilized in this review. <br />Rules 1.4.5, 1.6.2, 3, 6.1, 6.2, 6.4 and Rule 6.5. <br /> <br /> <br />Adequacy issues are numbered in italics below. <br /> <br /> <br />Rule 1.4.5(b) (iii): Application Requirements <br />An affidavit pertaining to posting of signs stated that signs were posted on 15 July 2021, adequately <br />meeting this rule. <br /> <br />Rule 1.6.2(1)(d) and (e) and (g) <br />DRMS notes notice was provided to the Board of County Commissioners for Weld County and the <br />Conservation District as per Exhibit K and that the application was filled with the County Clerk as per <br />Exhibit R. Notice signs were also posted at the mine site location. <br /> <br />1. Please submit proof of newspaper publication. <br /> <br /> <br /> <br />
