Item 17: The applicant accepts the bond amount of$10,500.
Item 19: The owner of the power line and gas line are Xcel Energy and are revised accordingly on
Exhibit E. CDOT is noted as the owner of Stanley Road.
Item 20: Exhibit E.2 is signed by Andy Jesik.
Item 22: Proof of filing this adequacy response with the Clear Creek County Clerk and Recorder is
provided herein.
Item 28: The Milling Agreement was revised as follows:
Item 10 and 11 includes characterization of both feedstock and byproduct material. Byproduct
characterization will determine if a material is candidate for a BUD or will require disposal.
In the event byproduct is a waste material, transport and disposal will be tracked and
documented via COCs.
The Byproduct Purchase Agreement provides opportunity for the material owner to sell the
byproduct to SGLLC if the byproduct material meets quality standards and a BUD is
obtained. Byproduct that is not a candidate for a BUD will be disposed of in the appropriate
disposal facility, depending on byproduct characterization.
Exhibit U 6.4.21(5)was revised as follows:
Feedstock sampling will occur for every 20,000 tons of material to be received.A
series of grab samples will be taken from within the stockpile at the source location as well
as along the periphery so that up to a 1,000-pound sample containing a mixture of coarse
and fine material is obtained. This sample will be crushed, blended, and split to produce a
representative sample for further analysis.
The following analytical tests will be conducted on all feedstock and byproduct material
to understand the potential environmental effects and subsequent appropriate storage,
handling and/or disposal of byproduct material:
• TCLP to determine if the material needs to be handled or stored as hazardous
waste. The results of this testing will be compared to the limits identified in the
Code of Federal Regulations(CFR)40#261.24 and the Regional Screening Levels
(RSLs) as defined by the USEPA (https://www.epa.gov/risk/regional-screening_
levels-rsls-users-guide).
• Acid base accounting(ABA)to determine the Net Neutralization Potential (NNP).
The concentrate will be stored in 55 gallon sealed drums in a secure area of the mill. It does not
undergo post-milling ABA or TCLP testing.
Feedstock samples will undergo a bench scale mill process. The bench scale byproduct will be
tested as described above. This testing will transpire prior to the mill committing to process the
feedstock.
The design of the feedstock and byproduct storage bins was provided in Item 8.
