Ms. Erica Crosby April 5, 2006
Division of Minerals and Geology Page 13 of 21
We have recently confirmed that there is an unregistered well in the southwest
corner of the Robbins property that is within 200 feet of planned disturbance.
Exhibits C-1 and C-3 have been revised to note this well, and C-3 also shows a 200-
foot setback area should Asphalt Paving Company not submit either a structure
agreement or an engineering analysis via a Technical Revision prior to mining in this
area.
32.A number of structures are noted on the map, but do not contain a description or
owner. Please describe the structure and state the owner of the structure and
update Exhibit C-1 and the table in Exhibit S accordingly (since it appears to be
within 200 feet of affected land). This includes:
A structure is located at the end of Christopher Road: The structure located at the
end of Christian Street is a residence on an illegal lot (located within the County road
right-of-way). We therefore have no information on the owner or resident of this
property. However, Asphalt Paving will commit to a 200-foot setback from this
structure, as shown on Exhibit C-3.
MW23 located east of WCR 23.5: MW-23 is a monitor well owned by Aggregate
Industries. The applicant will submit either a setback agreement or engineering
analysis to the Division prior to disturbance within 200 feet of this well. Exhibit C-1
and Exhibit S (below) have been revised appropriately.
Top Collection Facilities south of WCR 6: The TOP collection facilities located south
of CR6 are owned by TOP Operating Company, Asphalt Paving Company is in the
process of finalizing a Surface Use Agreement with this company, and will submit
this to the Division prior to site disturbance.
