A commitment from the applicant that they will provide the Division with a <br /> construction report and engineer's certification of the slurry wall prior to the <br /> exposure of groundwater. if the Division accepts that the report and <br /> certification demonstrate that the slurry wall will function up to standard, then <br /> the operation would be eligible for the reduced (20 percent of replacement cost) <br /> slurry wall bond. <br /> The applicant commits to provide the Division with a construction report and <br /> engineer's certification of the slurry wall prior to exposing groundwater via a <br /> Technical Revision. <br /> 29. The Division will estimate a cost to reclaim the site based on the information <br /> submitted in the application. However, please state the overall affected areas of the <br /> operation at any given time. In addition, the Division will include a cost to backfill <br /> Phase 1. It does not appear to be included in the estimate. <br /> Approximately 240,000 cubic yards will be required to backfill Phase 1, and the <br /> backfill will include overburden and reject material from on-site. The maximum <br /> disturbance of the site will occur towards the end of Phase 3, when reclamation may <br /> still be occurring in Phase 2 and only Phase 1 will be fully reclaimed. At this point, <br /> there may be up to 98 acres disturbed as follows: <br /> a. Plant Area — 15 acres <br /> b. Phase 2— 31 acres (in process of final grading and/or seeding) <br /> c. Phase 3— 52 acres <br /> Rule 6.4.19 Exhibit S-Permanent Man-Made Structures <br /> 30. The Gamueda structures (residence, outbuilding and well #17) and the Wilson <br /> structures (residence and outbuilding) appear to be located within 200 feet of the <br /> affected area, but was not noted on Exhibit C-1. Please revise the exhibit to reflect <br /> these structures that are located within 200 feet, and provide mining offset <br /> distances. <br /> Exhibit C-1 has been revised to include the required labels. Excavation will not <br /> occur within 200 feet of the Gamueda structures; however stockpiling and <br /> processing may occur within 200 feet, for which Asphalt Paving Company will submit <br /> either a setback agreement or engineering analysis to the Division prior to <br /> disturbance within 200 feet. Excavation may occur within 200 feet of Wilson <br /> structures, pending submittal of either a setback agreement or engineering analysis <br /> to the Division. <br /> 31. The Robbins structure located within 200 feet of the affected land was not included <br /> in the table of Exhibit S as being necessary to obtain an agreement to mine closer <br /> than 200 feet, provide an engineering evaluation or maintain a distance of 200 feet. <br /> Please revise the table in the exhibit accordingly. <br />
