remove such equipment, including, but not limited to pumps, motors and drilling <br /> equipment, used in connection with the drilling or use of such well. Lessee shall have <br /> the right to build such ditches, drains and pipelines and to construct water storage <br /> facilities and to store or control water necessary for the excavating and processing of <br /> said Material. <br /> 6. Mining Methods. Lessee may use such mining methods as it, in its sole <br /> discretion, shall establish so as to fully mine the Property commensurate with any <br /> restrictions placed upon the operations by any proper governmental authorities. <br /> 7. Cooperation with Potential Wind Farm. Lessor agrees to make timely <br /> notice to Lessee when a location is identified for the potential wind farm and <br /> appurtenant improvements so that the mining and reclamation plans can be designed or <br /> amended to facilitate said improvements. <br /> 8. Taxes. Lessor agrees to pay all real estate taxes levied against the <br /> Property before the same become delinquent. In the event Lessor fails to pay such <br /> taxes, Lessee, at its option, may pay such taxes and assessments as levied against the <br /> Property, and deduct any such payments made, together with any penalties or interest <br /> required to be paid, from any amount due Lessor hereunder. <br /> 9. Right of Termination-Lessee. Lessee may terminate this Lease at any <br /> time, by providing 90 days' advance written notice of said election to terminate. Lessee <br /> shall surrender possession of the Property to Lessor at the end of said notice period, <br /> subject to the provisions hereof, and shall execute a recordable instrument of release. <br /> 10. Right of Termination-Lessor. In the event of any default hereunder on the <br /> part of Lessee, and if Lessee shall fail or refuse to comply with any of the terms hereof, <br /> then at the option of Lessor, Lessor may give written notice to Lessee of such default, <br /> and unless such default is corrected by Lessee within 90 days after the receipt of such <br /> notice by Lessee, then Lessor shall have the option to terminate this Lease and Lessee <br /> 3 <br /> [10.21[REAL ESTATE 1(b)-Franciscotti Pit.pdq[Page 3 of 71 <br />
