The Lessor acknowledges the Lessee, Colorado Department of <br /> Transportation, and other Project funding agencies have a vested interest in, and the right of access <br /> and possession of any material imported to the property. <br /> 7 Defense of Use. Lessor warrants that Lessor owns the surface estate for the property, and Lessor <br /> agrees to defend said title against adverse claims that could impact Lessee's rights under this <br /> Agreement. <br /> 8 Termination. This Agreement shall terminate upon the completion of the Lease Term,final payment of <br /> rent due under this Agreement, and reseeding of the Property.
