LEASE AGREEMENT <br /> This Lease Agreement, is made and entered into this 14th day of June, 2021, by and between Lisa <br /> Cravener(the "Lessor"), and Zak Dirt, Inc., (the "Lessee"), (collectively, the"Parties). <br /> Whereas, Lessor owns a piece of property at 5095 Rodgers Dr. Hartsel, CO 80449, located in Park <br /> County, (the"Property"), that is adjacent to CDOT owned property on which Lessee has been contracted to <br /> remove and rebuild the existing bridge CDOT Project FBR 2854-143 (the "Project"). <br /> Whereas, Lessee wants to lease this property for use as a staging area for the duration of its construction <br /> project. <br /> THEREFORE, in consideration of the agreed Rent as set forth below in this Agreement, the sufficiency of <br /> which is hereby acknowledged, the Parties, intending to be bound by the terms hereof, agree as follows: <br /> 1 Lease of Property and Lease Term. Lessor leases to Lessee the Property on a month-to-month basis <br /> starting on June 14, 2021 ("Start Date"), for the duration of Lessee's Project, or until Lessee ceases <br /> use of the property consistent with the terms of this Agreement. The period from the Start Date <br /> through the end of the calendar month for the date Lessee last uses the Property forjob trailer setup, <br /> staging, storing of materials and excavating embankment material shall be the "Lease Term." It is <br /> anticipated there will 12,303 CY of embankment material excavated for the project. The Start Date <br /> shall be the first date the Lessee can use the Property. <br /> 2 Rent and Payment. Lessee shall pay Lessor the amount of$2.50 per cubic yard of embankment <br /> material excavated on the 5095 Rodgers Dr. property. Measurement of excavation will be completed <br /> every calendar month this Agreement is in effect and payable as a single payment due within 30 days <br /> of the end of each month. Please see attached site map for location of borrow pit and Job yard. In <br /> addition Lessor shall have first priority on any and all materials removed from the CDOT bridge project <br /> FBR 2854-143. <br /> 3 Acceptable Use of Property. Lessor grants Lessee the right to enter upon the Property and use the <br /> property for storage and construction operations, including placement of temporary fencing, <br /> construction materials, construction equipment, conex storage boxes, dumpsters, portable, material <br /> stockpiles, concrete washouts, and other items customarily found in construction staging areas. <br /> Lessee shall keep the Property in a neat condition and timely and appropriately remove all trash. <br /> 4 Forbidden Use of Property. Lessee shall not erect permanent structures,dump hazardous materials, <br /> bury non-native materials,or use the Property in a manner that would cause permanent damage to the <br /> Property, or violate applicable federal, state, or local laws. <br /> 5 Site Reclamation.Within two weeks of completion of the Lease Term, Lessee shall grade the surface <br /> of the Property at both the borrow pit and job yard to a condition as agreed upon between the lessee <br /> and lessor. Lessee shall also have the Property seeded with a native grass seed mix that closely <br /> matches the existing grasses found on the Property. Seeding shall only be performed during <br /> 1 <br />
