Elk Creek Mine (C-1981-022) MT-8 <br /> on May 22. <br /> Technical Revision No. 78 (TR-78) was submitted to the Division on February 28, 2020 and withdrawn <br /> on March 1, 2021. <br /> Minor Revision No. 112 (MR-112) was submitted to the Division on August 20, 2020, and found <br /> complete on August 26. MR-112 updated Map 2.05M-1, sheet 6 of 6; and Exhibit 2.04-E3 of the PAP <br /> in response to items noted in the inspection report of July 31, 2020, regarding Surety Release 02 (SL- <br /> 02). The decision to approve MR-112 was proposed and issued on September 30. <br /> Surety Release No. 3 (SL-3) was submitted to the Division on August 18, 2020, and found complete on <br /> October 1. SL-3 released 50.44 acres of GVB pads and roads from Phase II liability. The decision to <br /> approve SL-3 was proposed on May 5, 2021, and issued on June 5. <br /> Surety Release No. 4 (SL-4) was submitted to the Division on January 5, 2021, and found complete on <br /> February 4. SL-4 released 5.70 acres located at the Sanborn Creek Mine Portals area and Sanborn <br /> Creek Mine Fan site five parcels from Phase I, II and III liability; and a further 10.7 acres located at the <br /> Bear Creek B-Seam Portal & Fan-site (US Steel), Lower Hubbard Creek facilities area, and Hubbard <br /> Creek Fan #1 Site from Phase III liability. The decision to approve SL-4 was proposed on March 5, <br /> 2021, and issued on May 22. <br /> Section III - Status of Stipulations <br /> The stipulation history for the Elk Creek Mine was reviewed as part of the midterm review. The <br /> review included an investigation of any stipulations imposed since the last permit renewal, and any <br /> responses to existing stipulations received since the last permit renewal. Any stipulations associated <br /> with this permit and issued over the life of this operation which are not discussed in this midterm <br /> review have been complied with or terminated. <br /> Section IV— Permit Variances and Specific Approvals <br /> Variances from Approximate Original Contour (ACC) and Stream Buffer Zone rules were discussed in <br /> some detail in Section I. The variances are still appropriate, and the operator is in compliance with <br /> the terms of approval. <br /> Section V - Enforcement Actions <br /> No enforcement actions have been issued since the last permit renewal. <br /> Section VI - Identified Issues and Required Revisions <br /> The Division has identified a number of issues during the course of this review, which were discussed <br /> Page 21 of 22 <br />
