Elk Creek Mine (C-1981-022) MT-8 <br /> the water monitoring program will require a Technical Revision, with supporting data and <br /> analysis. Before water monitoring is terminated, the rule requires demonstration: <br /> ...that these qualities and quantities of runoff without treatment are consistent with the <br /> requirements of 4.05; that the operation has minimized disturbance to the hydrologic <br /> balance in the permit and adjacent areas; that the operation has prevented material <br /> damage to the hydrologic balance outside the permit area; and that the water rights of <br /> other users have been protected or replaced. <br /> Section II - Revisions to the Permit <br /> Surety Release no. 1 (SL-1) was submitted to the Division on February 27, 2019, and found complete <br /> on April 25. SL-1 released 19.4 acres of disturbed land located on the Lower and Middle Pads of the <br /> Elk Creek Mine facilities area and a portion of the East Yard area from Phase I liability. The decision to <br /> approve SL-1 was proposed on October 18, and issued on November 23. <br /> Technical Revision no. 77 (TR-77) was submitted to the Division on March 19, 2019, and found <br /> complete on March 22. TR-77 updated the revegetation plan to address vegetation sampling <br /> methods and success criteria for reclamation bond release in the light of changes to approved post- <br /> mining land uses, surface owner requests and the age of mine-related disturbances. The decision to <br /> approve TR-77 was proposed on July 15, and issued on August 6. <br /> Minor Revision no. 110 (MR-110) was submitted to the Division on April 23, 2019, and found <br /> complete on May 1. MR-110 made three minor updates to the Permit Application Packet (PAP): (i) <br /> concerning the use of a space within the permit area by United Companies, a contractor to the <br /> Colorado Department of Transportation; (ii) a correction to the General Facilities Gob vent Boreholes <br /> Sheet 2.05-M1, Sheet 6 of 6; and (iii) concerning 3D seismic activities anticipated to be conducted <br /> within the permit area. The decision to approve MR-110 was proposed and issued on May 1. <br /> Minor Revision no. 111 (MR-111) was submitted to the Division on July 8, 2019, and found complete <br /> on July 9. MR-111 updated the PAP with: (i) a minor textual clarification regarding the gradient of <br /> reclaimed slopes, and (ii) a description of activities to be undertaken by Gunnison Energy, LLC. that <br /> will occur within the mine permit boundary but that are not related to the operation or reclamation <br /> of the mine. The decision to approve MR-111 was proposed and issued on July 9. <br /> Surety Release No. 2 (SL-2) was submitted to the Division on September 16, 2019, and found <br /> complete on December 4. SL-2 released 66.05 acres from Phase I reclamation liability (West Valley <br /> Fill, 11 West Valley Fill, and a portion of the Gob Vent Boreholes and associated pads and roads); 70.36 <br /> acres from Phase I & 11 reclamation liability (Bear Creek B-Seam Portal & Fansite (US Steel), Lower <br /> Hubbard Creek facilities area, Hubbard Creek Fan #1 Site, and a portion of the Gob Vent Boreholes <br /> and associated pads and roads); and 2.33 acres from Phase 1, 11 & III reclamation liability (Bear Creek <br /> Fansite leased to Vessels).
