9. Approximately 10%of the process water will be retained in the concentrate or present in <br /> byproducts. <br /> 10. In the event of upset conditions resulting in process water pH being< 6.0, quick lime will be <br /> added to the segregated water in the holding tank as needed to adjust the pH to acceptable <br /> neutral range. Exhibit C narrative includes the following revision. <br /> Water will be tested for pH as it leaves the dewatering screen twice each day that <br /> the mill operates. Water with pH lower than 6 will be diverted to a holding tank. <br /> Quicklime (calcium oxide) will be added in a dry form and mixed within the holding <br /> tank as needed to attain a pH above 6. The quicklime will be palletized and <br /> delivered in 50-lb. bags with up to 2,000 lbs. stored on site at any one time. The <br /> pallets will be tarped and stored inside the mill building. <br /> 11. Stormwater control structure details are provided in Exhibit C. <br /> 12. Construction material byproduct will be evaluated according to ASTM C 33-03 (Appendix E). <br /> Byproduct materials that does not pass TCLP for hazardous waste determination will be <br /> returned to the feedstock owner in 55 gallon drums as described in the Milling Agreement <br /> Contract (Appendix F). <br /> 13. The contract to receive feedstock material includes a provision that the owner of the <br /> feedstock material will provide a BUD from CDPHE for the byproduct material prior to <br /> delivery to the final end user. <br /> 14. Surfactant will not be used during milling. <br /> 15. The closed circuit mill flow chart is included in Exhibit C and provided herein. <br /> 16. GTM will NOT impact the hydrologic balance and Exhibit C was revised accordingly. <br /> Exhibit D: Reclamation Plan <br /> 17. No response required. <br /> 18. In the event the application is unable to obtain a zone change from Clear Creek County or <br /> Mr. Lesser chooses not to sell the property, the property will be accepted from the operator <br /> after the described reclamation. The site will be used as Mr. Lesser's private property. <br /> Exhibit E: Maps <br /> 19. The Mining Plan Map was updated to show the names of owners of record of the surface of <br /> affected land within 200 ft. and the man-made structures. <br /> 20. The maps were prepared and signed by Andy Jesik, a professional engineer. <br /> 21. The Reclamation Plan Map was not revised since the property will be reclaimed as described <br /> but retained by Mr. Lessor for his personal use. <br /> Exhibit I: Proof of Filing with County Clerk <br /> 22. Please find the receipt of deposit of the revised application documents that were placed <br /> with the Clear Creek County Clerk and Recorder. <br /> Exhibit L: Permanent Man-made Structures <br /> 23. The chart was revised to include Stanley Road. <br />
