Mr.Frank Ferris of Elk Ridge Mining and <br /> REclamation,LLC accompanied the inspection and represented the operator. The mine is a predominately <br /> reclaimed surface mine. No coal is being extracted,nor has it been extracted for a number of years. <br /> AVAILABILITY OF RECORDS—Rule 5.02.4(l): <br /> Mine records were checked in the New Horizon Mine office at the end of the inspection. Records were <br /> complete and up to date. Items that were not initially located in the inspection notebook,were located by Frank <br /> and provided to the inspector. <br /> BACKFILL and GRADING—Rule 4.14 <br /> Contemporaneous Reclamation 4.14.1;Approximate Original Contour 4.14.2; Stabilization of Rills and Gullies <br /> 4.14.6: <br /> The operator has filled in the low area at the northwest corner of the irrigated pasture. Soil was hauled to <br /> this location and made level with the rest of the field to minimize any pooling and allow adequate drainage off the <br /> field. Frank stated that the farmer was on site while ERMR was doing the work and able to communicate to the <br /> operator during the activity. The repaired area had been seeded prior to the inspection. A small amount of tail <br /> water pooling was noted along the access route west of the field,but the field appeared to be draining <br /> appropriately. <br /> No additional grading or topsoil laydown has occurred at the former office/facilities area on the south side of the <br /> permit area. Frank noted that the operator needs to retain a topsoil haulage route when the sediment control <br /> structures are approved for reclamation. The operator is leaving this path available on the southern side of the <br /> Irrigated Pasture field.
