Notice of Proposed Decision
The Colorado Division of Reclama-
tion, Mining and Safety has issued a
proposed decision to approve Bond
Release Application No. 2 (SL-2)
for the Elk Creek Mine, Permit No.
C-1981-022. SL-2 releases approx-
imately 138.74 acres of reclaimed
surface facilities, coal waste piles,
mine ventilation boreholes, drill pads
and associated roads, as well as fa-
cilities that have been repurposed for
industrial or commercial uses. Rec-
lamation work was completed in the
areas requested for release between
1996 and 2017. SL-2 releases 60%
of the bond applicable to 66.05 acres
released from Phase I reclamation
liability (West Valley Fill, I I West Val-
ley Fill, and a portion of the Gob Vent
Boreholes and associated pads and
roads), 85% of the bond applicable
to 70.36 acres released from Phase I
& 11 reclamation liability (Bear Creek
B-Seam Portal & Fansite (US Steel),
Lower Hubbard Creek facilities area,
Hubbard Creek Fan #1 Site, and a
portion of the Gob Vent Boreholes
and associated pads and roads),
and 100% of the bond applicable to
2.33 acres released from Phase 1, 11
& III reclamation liability (Bear Creek
Fansite (leased to Vessels). The un-
derground operation is operated by
Oxbow Mining, LLC under the pro-
visions of the Colorado Surface Coal
Mining Reclamation Act of 1979.
The bond release application was
submitted by Oxbow Mining, LLC on
September 16, 2019. The affected
area is located in Delta, Gunnison
County, approximately 0 miles North
of Somerset, Colorado.

hearing regarding this proposed de-
cision. Requests for a hearing must
be made in writing within thirty (30)
days of the first publication of this
notice, and shall state with reason-
able specificity the reasons for the
request and objections to the pro-
posed decision.
