Notice of Proposed Decision <br /> The Colorado Division of Reclama- <br /> tion,Mining and Safety has issued a <br /> proposed decision to approve Bond <br /> Release Application No. 2 (SL-2) <br /> for the Elk Creek Mine, Permit No. <br /> C-1981-022. SL-2 releases appprox- <br /> imately 138.74 acres of reclaimed <br /> surface facilities, coal waste piles. <br /> mine ventilation borehoIas,drill pads <br /> and associated roads,as well as fa- <br /> cilities that have been repurposed for <br /> industrial or commercial uses.Rec- <br /> lamation work was completed in the <br /> areas requested for release between <br /> 1996 and 2017.SL-2 releases 60% <br /> of the bond applicable to 66.05 acres <br /> released from Phase I reclamation <br /> liability(West Valley Fill,I I West Val- <br /> ley Fii,and a portion of the Gob Vent <br /> Boreholes and associated pads and <br /> roads,85% of the bond applicable <br /> to 70. 6 acres released from Phase I <br /> &11 reclamation liability(Bear Creek <br /> B-Seam Portal&Fansite(US Steel), <br /> Lower Hubbard Creek facilities area, <br /> Hubbard Creek Fan #1 Site. and a <br /> portion of the Gob Vent Soreholes <br /> and associated pads and roads), <br /> and 100%of the bond ap licable to <br /> 2.33 acres released from hase I,II <br /> &Ill reclamation habihty{Bear Creek <br /> Fansite(leased to Vessels). The un- <br /> derground operation is operated by <br /> Oxbow Mining, LLC under the pre- <br /> visions of the Colorado Surface Coal <br /> Mining Reclamation Act of 1979. <br /> The bond release application was <br /> submitted byy oxbow Mining,LLC on <br /> September 16,2019.
