Exhibit D: .please clarify that the topsoil being brought onsite will be in addition to the 8- <br /> inches of topsoil that will be spread once mining is complete <br /> a. The topsoil being brought on site is NOT in addition to the 8-inches of topsoil that <br /> will be spread. There is very little topsoil at the proposed borrow location and <br /> without the imported topsoil,Ames would not be able to spread 8-inches of topsoil <br /> on the affected area once mining is complete. <br /> 2. Exhibit D: please complete a signed affidavit certifying ing that the material is clean and inert <br /> a. Please see the attached completed affidavit. <br /> 3. Exhibit L: structure agreements <br /> a. Fiber Optic belonging to Nunn Telephone Company: <br /> i. Ames has still had no correspondence with Nunn about their fiber optic. <br /> Therefore, please see the attached engineering assessment and <br /> demonstration exhibit showing pothole photos confirming that the fiber <br /> optic conduit is buried over 48 inches at the shallowest point,which exceeds <br /> the ASTM F512 minimum required 36 inches of cover. <br /> b. Weld County Road 110 belonging to Weld County: <br /> i. Ames had a meeting with Weld County on Monday,April Stn to discuss <br /> obtaining a structure agreement.Ames fully anticipates that it will reach an <br /> agreement with Weld County. Currently,Ames has sent in an access permit <br /> application for the Burnham Property Borrow and is now awaiting a Road <br /> Maintenance Agreement from Weld County (This should come by <br /> Wednesday,April 7). Once the Road Maintenance Agreement is received and <br /> signed, the Structure Agreement will be singed and given to the DRMS. <br /> 4. Other: please demonstrate that the Applicant's response to these adequacy issues have <br /> been placed with the application materials previous placed at the Weld County Clerk <br /> a.
