The following list summarizes the major permits that <br /> would be needed,upon BLM issuing a mineral materials contract to Mountain Valley <br /> Excavating: <br /> • Colorado Division of Reclamation, Mining and Safety (CDRMS)—Construction Material <br /> Permit I I0(c) <br /> • COG5000000 (Sand and gravel mining process water and stormwater combined)— <br /> Colorado Department of Public Health and Environment(CDPHE), Water Quality <br /> Control Division(WQCD) <br /> • CDOT, State Highway Access Permit <br /> • Air Pollution Emission Notice(APEN)—CDPHE, Air Quality Control Division <br /> • Substitute Water Supply Plan(SWSP)—Colorado Division Water Resources(DWR) <br /> • Mining, Safety and Health Administration(MSHA) <br /> • Fremont County—conditional use permit <br /> The project proponent will be responsible for adhering to all applicable County, State and <br /> Federal laws,regulations and permit requirements and stipulations. <br /> RECLAMATION <br /> Interim Reclamation <br /> Mining would occur in 2 phases with Phase 1 reclamation efforts initiated simultaneously as <br /> Phase 2 begins. Interim reclamation of Phase 1 would consist of regrading and recontouring to <br /> the natural topography, restructuring the stormwater features to encompass Phase 2 activities, <br /> moving the processing area(e.g. processing equipment,product stockpiles, etc.) and other <br /> mining related equipment within the Phase 2 boundaries. Final reclamation would include <br /> ripping, scarifying and reseeding of Phase 1 once all material has been exhausted from Phase 2. <br /> During active operations, the highwall would be sloped to aid the operator during final <br /> reclamation. <br /> Final Reclamation <br /> The reclamation plan would provide BLM, CDRMS and other applicable agencies a guideline <br /> for interim and final reclamation requirements. Final reclamation would be determined complete <br /> once conditions in the reclamation plan have been met and, as applicable, the BLM reclamation <br /> standards provided in Appendix B. All reclamation would be projected to occur within the first <br /> two years with routine monitoring to continue for a minimum of 4 years. <br /> Final reclamation would be conducted in a timely manner, approximately 6 months post-closure <br /> date.
