Any permit or contract so issued must contain the stipulation set forth in paragraph III of <br /> the memorandum and the powersite stipulation as follows: <br /> Paragraph III <br /> That the U.S., its permittees, lessees, and licenses shall not be responsible or loss of any <br /> land,crops, facilities installed or erected, income, or other property or investments <br /> resulting from the use of such lands or portions thereof for power development at any <br /> time where such power development is made by or under the authority of the United <br /> States. <br /> Power Stipulation <br /> That in the event the said lands are required for power purposes, any improvements or <br /> structures placed thereon which shall be found to interfere with such development shall <br /> be removed or relocated as may be necessary to eliminate interference with power <br /> development at no cost to the United States, its power permittees, or licensees. <br /> 2. No disposals may be made from within an operating power project. <br /> 3. No permit or contract shall be for a term of over 5 years, except with prior consent from <br /> the Federal Power Commission. <br /> FERC has no authority to dispose of mineral material from lands withdrawn for powersite <br /> purposes. <br /> Interim Management Plan <br /> For extended non-operational periods, the operator would follow specific guidelines proposed in <br /> the mine plan and other contract and permit stipulations. Portable processing equipment would <br /> be removed when the site is not actively crushing material,and all other heavy equipment would <br /> either be secured or removed from the site. All petroleum, oil, lubricants (POLs)and other <br /> chemical substances would not be stored onsite during inactive periods. If a gate is required by <br /> BLM or another government agency,the entrance gate would remain locked and any fencing <br /> secured prior to closure. Though there would be no guard or personnel onsite, the operator would <br /> monitor the site by means of weekly inspections to ensure the site conditions, stockpiles, <br /> structures, etc. remain in compliance with the plan on file. <br /> Stormwater and Drainage Management <br /> Stormwater drainage controls would be installed simultaneously to site preparation. These <br /> controls would divert surface flow and sedimentation from the proposed mining and staging <br /> areas. Drainage controls would consist of earthen berms along the northern and eastern boundary <br /> and roads,drainage ditches, culverts, silt fences and a 4-inch riprap sediment/catchment pond. <br /> 10 <br />
